I've heard nothing about the 485, but agreed. I'm in no rush for the interview as well. I think people from New York are just delayed from the sheer volume of applicants that apply from here. One thing that I did too, was basically talk to a T2 officer every two weeks or so, I know its excessive but I really wanted to know what the case update was. Seeing how they received your RFIE on 2/14 I wonder if they would have any updates

Yeah. We're calling tomorrow to speak with a Tier 2 officer. It's always such an emotional rollercoaster speaking with them though - we've gotten a couple of really nice people, but also a couple of super super rude and aggressive folk. Considering the answer we've always gotten is "yeah just keep waiting", I feel like a sucker for punishment when I call.

April 2020 - January 2021 RoC

Jan 2022 - September 2022 Citizenship

Hey Guys,

 

New VJ member here and august filer. I would like to share my story here and hopefully you guys can lay out how y'all think my process is gonna go. I have read quite a few pages of this August AOS thread and i must say the support from this thread of filers is quite immense. Alright enough with the long talk. Here we go.

I came here on an F1 visa in 2006 and graduated and all and have been outta status since 2012. I have been married since July 2014 and couple months right after that we were getting ready to file AOS but unfortunately my wife has been dealing with addiction and got in trouble with the law so we paused that for a number of years as she was incarcerated and dealing with her heroine addiction. She is now better and 2 years sober so we finally filed in August of last year. We have a 6 year old son as well and we are expecting a 2nd child later this year.

It has been 183 days and i still havent received my EAD. My PD is Aug 28, RFIE on Sep 26 for Affidavit of Support, Oct 11 USCIS received our response and our case was updated on the website. Since then nothing. 139 days since they received my response. I had congress reach out and she replied with this USCIS response "

Thank you for your inquiry regarding this constituent’s immigration matter.  This case will be routed for expedited processing.  Once this case is reviewed, your constituent will receive a decision or notice of further action.  Due to the extremely high volume of expedite requests for this case type, there are numerous cases involving exigent or humanitarian issues already in the expedite queue, and we are unable to provide a specific timeframe for the expedited review.  The strict enforcement of the expedite criteria means that all cases sent for expeditious handling are urgent, and we assure you that this case will be adjudicated as soon as possible.

I will say it was absolutely nerve wrecking for me. We went in rather confident because our case is pretty clear cut. But then the USCIS worker started asking a lot of questions about my husbands German police record (two small misdemeanors from a while back). After the interview we waited another 20 minutes in the waiting room. The whole time I kept saying over and over “I’m so scared”. 

 

Later he came out, called us to the hallway and gave us a paper saying it was approved. I just about melted. The whole process took about two hours. Most of it waiting. Status online updated to card production the next day. 

 

I tell you, this whole immigration process has been BRUTAL! But thankfully we’re all getting closer to being done (at least for two years 😉).

yes, once you get approved for AOS..since you have been married for more then 2 years you will get the 10 year GC... as for citizenship IF you are still married you can apply for it 3 years after you get your GC..

Nice! Glad to hear and congratulations.  I was even more curious because it's the same local office as mine :)

My husband is a USC but when he filed for me, he was a GC holder.

I had my AOS interview on feb 6 in San Jose and my interview was smooth; However, I haven't heard from USCIS. We have been married for just over 2 yrs (Jan 2018 we had our second anniversary).

when should I contact USCIS to check the status of my AOS interview?

guys good news!!! My moms EAD renewal finally got approved JUST now after 204 days. PD was 08/07/17... no word yet on my fathers even though we sent them at the same time (it could be because we did get a RFE this past Friday for his I 485..so maybe that's why)

Well.. i got an RFIE update after 190 days... I am so sad and discouraged. Dont know what it is about... Possibly income because my husband was just under  $ 20000 (household of 2) which is why we included 55000 $  of assets(his mutual funds 35000 $ , my 15000 $  transferred from France in US bank, + bank account) all that with a ton of evidence... Which should have been enough to cover the difference even if they didnt consider my assets... We even paid Rapidvisa service to check our package...  : (

RFE for EAD or AOS?

 

Hopefully is something simple that you can figure out and return ASAP. keep us posted when you receive it. I am to waiting on a RFE for my fathers AOS... status changed on 2/23/18 but have not gotten the actuall letter yet...

July 15, 2016 -> Got married
August 3, 2017 -> Mailed AOS packet (I-130, I-485, I-765)
August 4, 2017 -> Package received
August 14, 2017 -> NOA for I-130 and I-485 (not I-765... called multiple times to ask about this but was told to wait)
August 25, 2017 -> NOA for Biometrics Appt (I-485)
August 30, 2017 -> Sent email asking to look for I-765 (My I-765 was LOST)
September 8, 2017 -> Biometrics Appt for I-485
September 26, 2017 -> Received email from USCIS I-765 found and PD August 4
October, 2017 -> NOA for I-765 and Tier 2 officer cancelled 2nd biometrics

November 3, 2017 -> Raised SR online for I-765

December 11, 2017 -> SR showed as "completed" by the assigned officer

January 8, 2018 -> Name was updated

Yes, like other person already said, you should expect a 10 year greencard because you guys are married for more than 2 years, and apply for USC after 3 years 😊

Timeline (From B2 visa to AOS)


July 15, 2016 -> Got married
August 3, 2017 -> Mailed AOS packet (I-130, I-485, I-765)
August 4, 2017 -> Package received
August 14, 2017 -> NOA for I-130 and I-485 (not I-765... called multiple times to ask about this but was told to wait)
August 25, 2017 -> NOA for Biometrics Appt (I-485)
August 30, 2017 -> Sent email asking to look for I-765 (My I-765 was LOST)
September 8, 2017 -> Biometrics Appt for I-485
September 26, 2017 -> Received email from USCIS I-765 found and PD August 4
October, 2017 -> NOA for I-765 and Tier 2 officer cancelled 2nd biometrics

November 3, 2017 -> Raised SR online for I-765

December 11, 2017 -> SR showed as "completed" by the assigned officer
