My request to expedite just recently got denied, and I'm not ready to give up yet. When I originally called to make the request, I was told by the agent that there was also an option to make the request online. I can't find this option anywhere on the USCIS site. Was this agent mistaken, or am I not looking in the right place?

 

I'm hoping I can find a way to make the request in my own words, as relaying my situation through the agent can definitely cause some things to be left out.

Expedites are difficult to obtain.  I would suggest before you request another expedite that you get all of your evidence lined up and you make sure that your reasoning fits the criteria for an expedite.  

 

You cannot technically file an expedite online but you can open a service request.  I was told when I filed for an expedite that you could do it online but there was nowhere to do it online so I just did it through an agent.

Yeah. I heard they're notoriously though to get, but I was sure I provided all the information they needed. I guess financial loss is difficult to prove, and they don't exactly tell you what kind of evidence they'd like you to provide. 

 

Anyway, thanks a bunch for the reply. I'll give them a call and see if I can make another request.

I agree that financial loss is very difficult to prove- what evidence do you have?

 

I would say financial loss is the most difficult to prove given that you've lived your life here in the US without your significant other's help so they don't see why you could not continue doing that.  

 

It's also difficult because getting your fiancee here sooner does not necessarily end the financial hardship on you.  They are not able to work for at least about 4 to 5 months after they arrive in the US, which costs you more money for living and immigration costs. 

 

So it's as if you're saying you're having financial loss because they aren't here, but then you have to prove at the interview that you make enough (or have found a co-sponsor) to support you and your fiancee- they kind of clash.

The issue is that my fiance recently graduated university and will be forced to move from her free university housing. 

 

She's been having a bunch of trouble finding a job to support herself because of her plans to move as soon as she is able. I'm going to need to start sending her money so she can afford to live.

 

I tried sending them proof that she graduated recently, as well as proof that she'll no longer have a place to stay after the end of the summer. Apparently that wasn't enough.

How much does the expedite speed up the process? K1 is already faster than the IR1/CR1.

 

It's a lot easier to prove financial loss for a immediate family visa or a work visa than it is with a fiance visa though. The reason being that your situation is not unique.

 

In my case, for example, we are currently supporting TWO of everything until we get married and of course there is a financial burden involved. Two homes, two insurance policies, two cars, two grocery orders, etc, etc, etc... When we're married we will only have one of everything and our financial situation will improve immensely.

 

Yes, I have been sending my fiance support each and every month for nearly 2 years now in order to simply pay the bills and survive.

 

Would our financial burden be lifted once we were married and living together? Yes... Does this mean that they granted me an expedite? No. Then again, I never really thought to try as I figured my situation wasn't unique enough to warrant it. If it was, every single person here would be filing to expedite the process.

Are you the USC petitioning her?

 

If so, there is your problem. For most financial loss/burden claims you have to show evidence that the financial loss or burden is on YOU, not the immigrant fiance. Expedites are tough to get because they are already overburdened. 

 

You can try again but don't expect a different result.

My answer would have been the same as the above poster. 

 

That's not a financial burden to you, so they more than likely won't approve an expedite.   To them, she could always get a job to support herself or move in with family/friends- it is your choice to send her money to live, and in doing so you're making her burden your burden. 

 

I'm not saying relationship-wise that it's the wrong thing to do, just giving you the side that immigration probably sees.

I'm going to need to start sending her money so she can afford to live. - How would she take care of the situation if you were not there? It is great that you can help, but she probably has resources available to her also (family, friends, temp agencies, emergency housing, etc.)
