Ok I am married to an American and we live in  Brazil, in fact I already gave her her Green Card from brasil through our marriage, as she liked to live here with me, and I had to make her legal here in Brasil, and now I just want to come to visit America but I have this conviction from when I was younger on my  Record that blocks me from getting a

turist visa like a B1 or a B2 so can I file a I601 waver or just like a K-3, what do I do, I just want to visit her parents as I am e medical doctor and have my jobs here, we are both here and living in brasil for the past 4 years what,  do I have to do guys can anyone help me?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You had a conviction in the US? So you've been to the US before?

 

K-3 is not an option. They're obsolete and almost never given out anymore. So, you need to try for the visitor B-1 visa, for a temporary stay that's really the only option. There is no 'visit family in the US' visa unfortunately.

D3 is the visa for a B2 Tourist Visa, needs the applicant to be otherwise eligible and is basically a recommendation by the CO.

Yes I have been to the USA b4, lived there for like 4 and 1/2 yr,  been convicted of driving under a suspended license, and 01 driving under the influence (alcohol).

 

Have never been deported. I actually left on my own, I have been acquitted of all of my charges whilst Being in brasil, paid a layer there, and he helped me with everything, I have no bench warrents, I have a clean record right now...

 OK however as I said before every time I try to get a B1 or a B2, which are tourist visas,  just about any tourist visa or whatever they say I need a pardon or something like that, so I was wondering was he talking about a waiver and what waiver is that? Is it a D3 or is it a I 601?

D3 for non immigrant, but not sure you need a waiver Are they CIMT's? First thought is no.

 So sorry but, what is a CIMT? I have no idea what that eponym is at this point since I have only decided for this visa lately...

so all the jargon that there is out there, I am not familiar with...

Oh just found out what that was that, well yes there was I was also trying to get steroid from a pharmacy, since I was studying at a very prestigious school in the us, but I never used and I never bought it...

but all of this is been over 20 years ago and I still don't get a tourist visa every time I go get a visa here in Recife, umbeliveble.

Doesn't matter how long ago it was it will stay on your record. For the safety of US citizens Immigration doesn't have statute of limitations. Doesn't mean you will always be denied for it, but it will always be seen by them.

Drug abuse is a serious issue. Certainly is for Immigration.

Well that's not drug abouse, in fact my lawyer said that, it was steroids, and all athletes in the world take it, and by the way I never took it, since I was waiting out side of the pharmacy for the prescription, I was too skinny at that time, the judge totally understood and released, made it to a misdeminour,

i was attending one of the football story shoots in the area.

A Misdemeanour is a type of conviction, less serious than a Felony. But pretty serious.

Make sure you explain all of that when you apply for the D3 waiver.

OK now that leads to my next question guys:   So what is the difference between the D3 waiver versus the I 601 waver? the i601 was the one that I was originally thinking of doing, but someone how someone in here talked about the d3, so I am a bit confused, also you guys have to remember I am currently in Brazil and my wife is also in brasil as  e born live here, my wife is an American citizen, she was born in America....

D3 is for non-immigrant visas such as a B2 tourist visa. I601 is for intending immigrant visas like K-1 or adjustment of status.
