ROC received RFE notice on Monday Help!!! (merged)

I have received the RFE - request for additional evidence as well from VSC after a year - annoying thing is that the most of the evidence they have asked for I had already provided but apparently it was not sufficient! not sure how long will this take now. they have given a deadline up to 4th Aug-17.

- Children as a result of marriage- we don't have any children for now, does it mean we have a weaker case?? apparently thats on of the things they have asked for.

No, it doesn't mean you have a weaker case per se, but they do take into account cultural expectations of where your spouse is from and the outlook on waiting to have children. Not sure if that impacts you or not because I can't see your country flag icon....site must be getting buggy.

 

- Evidence that you have resided together either mortgage or lease- we have been living at father in law place so have none- what should I provide?

Notarized, sworn statement from father in law that you have been staying there since X date. Be ready to explain why, not a big deal either. Can counter act this with things like bank statements and car insurance/DLs that show the address. 

- Evidence that you and your spouse have made estate. health and financial arrangements with each other:

a will, a trust or durable power of attorney affirmed by atleast 2 people. not sure what am I suppose to provide? do I need to get a will drawn up now? Don't run out and get a will. I didn't, but I considered it. Financials are inheritance type things, spouse listing you as a payout person for life insurance, 401k stuff, retirement funds, health insurance policies and so forth.

 

- Affadivt from 3rd parties- we had provided 3 of these before- does it mean they didnt accept them? do we now need to ask different people? can family members provide that? 3rd parties are people who have no vested interest in your marriage. One from a priest/imam/rabbi is a good example, they are a neutral party. Co-workers. Neighbors. It can't hurt to get them if you can.

 

the letter states that they may wave interview requirement if sufficient evidence is not provided. does it mean that the interview is highly likely? not that It bothers me but I have travel plans and may not be around so it's causing lot of headache/stress.

 

your commments/suggestions will b greatly appreciated. 

 

Interview chances are about 50-50 for ROC. Your RFE letter sounds like a basic template of one, nothing to be too worried over, :) just send them what they asked for.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

Thank you so much for taking the time to respond. the main issue for me has been that we still havent completely settled in US. we have mainly been living together in UK- We have been coming over here and filing joint tax returns etc but most of our evidence i.e. utility bills and card statements are from UK- does that make a difference? do they only require US based evidence for good faith marriage or one can include documentary evidence from other countries as well?

Any.

Doesn't matter where it is from, as long as it shows joint aspects of life together. It could be argued that showing joint aspects concurrently from two different countries is stronger evidence.

No children? Then documents can't be provided, simple as that. 

No it does not weaken your case.

Will/estate: automatically goes to spouse - unless complicated by something like children (which you say you don't have) or an ex-spouse perhaps, or some other complicating factor.

Medical power of attorney: again, in most cases a lawful current spouse automatically has this in the event of your medical incapacitation, so stating it in writing could be viewed as somewhat pointless, unless there are complicating factors.

 

There is no legal or moral obligation to have either of these, and many millions of people manage just fine without them. They can also be contested in court even if you do have them.

A letter stating the facts - that you have been living at no cost at family property for X amount of time. Again, not illegal. Provide what you do have - joint mail, documents showing both names at that address etc.

 

 

Remember - you can't provide what doesn't exist, and you don't exist to live your married life according to some USCIS checklist they have deemed appropriate. Everyone is different.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Same as you Adrift I got RFE after a year.! And until now still trying to collect what uscis asked it's so frustrated and worried because my partner can't get me health insurance cause it is too much expensive I have no idea what to do now! I still have faith to god I trust him, good luck to us

RE: the living arrangements - as stated above, get a notarised affidavit from the father. My husband and I have a similar arrangement with the mother in law. When we were called for interview, we got official affidavit wording from RocketLawyer, gave it to the people who were doing one and they used the template to write affidavits which they then got notarised. We also did our own notarised affidavit of residence. We made Powers of Attorney two weeks before the interview. I ended up in hospital and my husband actually acted as my POA. We have no kids.

 

The POAs, hospital photos etc were some of the only things she looked at.

RE: the living arrangements - as stated above, get a notarised affidavit from the father. My husband and I have a similar arrangement with the mother in law. When we were called for interview, we got official affidavit wording from RocketLawyer, gave it to the people who were doing one and they used the template to write affidavits which they then got notarised. We also did our own notarised affidavit of residence. We made Powers of Attorney two weeks before the interview. I ended up in hospital and my husband actually acted as my POA. We have no kids.

 

The POAs, hospital photos etc were some of the only things she looked at.

Do affidavits have to be notarized or is it just personal preference?

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

07-11-2022: Naturalization Interview

They don't HAVE to be, but it looks better if they are. Plus it doesn't take much effort. A lot of banks and credit unions provide notary services for free. That said, affidavits are far from primary evidence anyway, so I'd focus on that first.

Quick advice! Please help, about my RFE letter and trying to do and organizing paperwork to send back to uscis but having problem with my husband. I just talk to him this morning asking if we could go to bank and find out if he can add my name on the car title but he just yelled on me, it's almost a month and we have nothing yet except my friend letter I don't know what to do. I felt like he don't cares my RFE he just told me he don't want to go or do anything today.

Questions: 1. Is there anyways I can do this by myself?

Is there anything else you can show USCIS besides the car title deed?

 

I'm so sorry that your husband is so frustrated. Perhaps he is just tired of having to always get stuff sorted for immigration (remember this process has been hard on him too). 

Find out if there's something bigger going on in his mind. You want to know exactly where you stand because this is more about you than him(basically). Speak to him calmly, with concern but also stress that you can't leave the RFE hanging and he had agreed to this entire process anyway.

 

I hope things work out-please keep us posted!

Was the letter from your friend the only bona fida evidence you sent? Those letters carry little to no weight.

 

Forget about the car deed, most on CR/IR-1 don't have comingling of finances yet. What you need is pictures together, passport stamps/boarding passes of trips taken to see each other, chat logs, emails etc.

She is doing ROC.

 

Just found her other thread, she does not have a lot of evidence at all.
