Date at PoE or date from petition approval?

Amazingly we have already been assigned an NVC case number after having sent off the I-130 on March 2, 2017. I am doing extra research now for the next steps, but skipping ahead to moving ----

Our second wedding anniversary is October 4, 2017. If we enter after October 4, 2017 will my husband receive the 10 year?

I've read that it is determined based on entry and I've also read that it's based on petition approval date, but can someone please confirm with a legitimate source? I've called the border patrol in Detroit and the officer didn't quite understand what I was asking because he said everyone gets a conditional visa, lol...

I agree with KierenHby entering on October 5th is safer it guarantees that the length of marriage is 2 years.

Request embassy change: May 2013

Son born: September 2013 (added to petition March 2014)

Interview: March 17, 2015 (Joint sponsor needed)

Joint sponsor documents submitted: April 27, 2015

Visas approved and issued: April 30, 2015. Had to return to embassy to do oath for son :)

Visa in hand: May 5, 2015 (two working days after issued)

IV fees paid: August 10, 2015

POE: JFK - September 10, 2015 (one day before visa expiry date - No hassle)

Returned to Barbados: September 28, 2015

You're right...if you've been married 2 years at time of entry, you'll get the 10 year visa.

 

You've just set a new record, however, for getting approved at the Nebraska Service Center...under 1 month!   You can take a look at my timeline which gives you a sense of about as fast as it can go at NVC/the consulate without an expedite.   That should help you time things.  The only thing to keep in mind is that your medical is good for 6 months from when you get it, but I don't think you'll get that far ahead that it'll be a problem.
