Hi guys, 

Again me looking for some advice. 

 

My friend filled his AOS petition on January 31. He is waiting for his Advance Parole card before he needs to travel for a weekend. He was expecting to receive his AP/EAD by the end of April because he is traveling the first week of May. I know is going to be pretty tight and there's a chance he is not going to be able to receive to receive his card on time. He needs to travel because they planned their wedding on May 6th, on his home country. All their family is waiting for this... Any recommendations? Of course they cannot change their wedding date... I was thinkin maybe traveling abroad and then his wife can travel again to bring him the card once arrived so he can reenter without problems?

No plans should be made without having the proper documents in hand. Seems like ap/ead is currently taking around 4 months. If this friend wants to keep the aos going, it's best to wait to receive the card in hand before making any travel. If the wedding in home country is that important, by all means, go ahead and do it, getting back into the US may prove difficult (if not impossible) though

Definately agree with above. I wouldn't suggest leaving period without the AP in hand. While not impossible to re-enter possibly even with the card being hand carried down to him, why risk possibly being denied entry back...

 

Always important(and too late now obviously) to not make these plans because no one can fully predict the time line for USCIS and all that; they are only time lines based on averages, not guaranteed.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Golden Rule:  Never plan anything without proper immigration documentation in hand.  We all know how USCIS immigration processing goes.  Our EAD/AP took 108 days to be approved and another 10 days to receive the actual card. I'm seeing some posts of those who are 130+ days without word of AP approval yet.  Not sure why you planned something so soon without waiting for the card.  If it were me, I would not travel in these current questionable government antics without it.

If he doesn't have the AP in hand yet leaves the country he will abandon his AOS and will be stuck outside the US until the petitioner files a new AOS. The wife bringing him the card is risky also because the AOS could require an interview.

 

"Of course they cannot change their wedding date..."  Sorry but this was his error in planning. If they are absolutely adamant about not changing wedding plans then have him abandon the AOS and wait in his country for his new wife to petition him for a spousal visa. Will take a year. Otherwise they should be prepared to change wedding plans.

 

But curious, what status is he AOS from?
