I apologize if this has been asked/answered. I met my fiancee twice in person but the last time is *over* 2 years ago. This is related to the distance and other factors. Is this grounds for a petition ? Thoughts ? Thanks!

I'm sure this post will be moved soon.

But no, unless there are INCREDIBLE religious reasons that you can't meet before marriage, you will have to meet . If you've already met once, there's no reason in USCIS's eyes that you can't meet again. Everyone's got the distance issue, as we're all international relationships, and most people do run into financial hardship visiting, but it's recommended to save up and go visit to satisfy the meeting within two years, there's no other way around it.

You have to meet face to face in last 2 years in order to be eligible for the fiancee visa.

Unless you have some extreme important religious or health reasons they you MIGHT ask for it to be waived.

 

All of us are/were in the long distance relationship lol, so USCIS won't grand you an exception just based on the distance.

I agree with the others. The I-129F has a strict requirement that you have met at least once within the past 2 years. The only exceptions are for very extreme circumstances...distance, financials, etc. issues are not a basis to waive that requirement.

@Ash.1101 is spot on. If you have met before you can meet again. USCIS is very strict on a lot of requirements and meeting in person is one of them.

Is the post in the right place now? Sorry if I posted in the wrong place.

 

I am aware of the requirement, my question was is it grounds for a petition to lift the requirement and I guess the overwhelming answer was "no". Okay, got it, thank-you.

 

This answer brings me then to a natural follow-up: if I visit again to satisfy this requirement, would getting married in the other country and applying for a spouse visa be better or worse and why than applying for a fiancee visa? Thanks again and sorry for posting in the wrong place.

Correct - there is no ground to lift the requirement. There is a waiver for extreme circumstances that prevent you 2 from meeting, but that doesn't apply to you.

 

That's a decision for you to make. The spousal visa takes around a year or so now from filing to visa in hand. It is a simpler process overall (no AOS needed), and cheaper. It also grants LPR status upon arrival, so the beneficiary can work and travel abroad immediately. The K-1 visa requires AOS and you can't work or leave the country until you get EAD + AP, which take about 3-4 months currently.

Applying for a spouse visa is cheaper, spouse gets green card upon arrival, but takes 12 mos avg. 

Apply for a fiance visa is faster, gets fiance to the US in 6 mos avg, but green card process costs more in fees.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
