Been soo slow lately... It's really getting to me now.. I'm not going to be able to take my son as his dad have more money to spend in court and I had to fold after spending all my savings..but at least I've got a court order which states that I get him every single holiday and he can choose where he wants to live when he's 10.... I'm so upset and now when things are slowing down I just feel like I want to just get over there cos I need my fiancee.. I think I understand everyone's frustration with waiting now.. I had so much going on here that I didn't have time to think about it but now that everything is set I feel it just wasting time. I dont think anyone understands what it feels like to be living month by month.. like you can't even plan anything further than a few months away because you never know when you're visa is coming through.. i dont even buy anything here now, no clothes or anything for the house because again is it going to be worth bringing everything over.. sorry for rant, just getting frustrated with the process..

I'm very sorry to hear things didn't go as you wanted regarding your son's custody :( 

I very well understand your frustrations and that feeling of being wasting time. I've been ready to leave from over a year now. I also feel I'm living month by month... Well, more like week by week and even day by day.

To add to it, I don't have a job right now. Trying to get a temporary one since I came from US end of March. Funny enough, when I'd normally have got a call or two back, this time I got already 4... And it turned out they all were looking to turn the temporary position in something permanent later on so, of course, when I told them about the visa, that eliminated me automatically.

I am so ready to move on and out!

 

But yep, nothing to do except for being patient. And with our luck so far, probably not getting our NOA2 any time soon. Oh well... We'll see :) But i dare you to prove me wrong, luck, destiny or USCIS ;)

So sorry to hear about your son and the situation with his father. It's really sad when the other parent wants to such a (insert the word of your choice) and not realizing that it hurts the child more than the other parent. Hopefully, when you are settled here, things between you guys can be a little more civil and that he will let your child visit more than just the holidays. It burns my core when a parent can be so vindictive using the child in this way. Plus, this "process" does not make things any better with the waiting and not knowing or being sure of what you're next steps are gonna be. I'm the USC, and I feel like I'm living month to month myself: trying to space out my vacation days; saving as much money we can so that we can "plan" a wedding; delayed house hunting because I need to save up as much money as possible, etc.

 

The biggest wait we have right now is delaying us having our first child together because I don't want to raise our child here alone while he's there and unable to experience all the milestones so forth. This part is really hard to do because of my age (I'm 37, he will be 30 in Sept.); and for me, I would be starting ALL THE WAY OVER as my son is 14. So for every day we wait, is another day taken away from conceiving; and you what they say: my biological clock is ticking very loudly. 

 

It's crazy because I just had this talk with my fiance last night and he said to me that we will pray that things go the way they are supposed to go and we get approved but if not, we're still gonna be together and just have to try doing things the other way (apply for the spousal visa). And while I know that would definitely be our next steps if things don't workout in our favor for the K1, but I had to tell him last night, let's not speak this into existence just yet and keep focus on the getting approved. While I know that without a doubt in my mind that I would file the spousal visa in a quick heartbeat, just the idea of having to start all over again and the waiting would probably put break me down inside.

Amen to that. My fiance's son is 10 years old and has never been in the States. Her mom also has the habit to cut off communication randomly, so no, that's not easy to deal with.

Guys

Lets say that everything goes as planned and we received our NAOs2  by the end of the month,

How much more time (approximately) do you guys think the process will take until we get the K1 VISA?

Just estimations,

 The waiting is killing me and I just want to set my mind that by (INSERT ESTIMATED MONTH HERE) I will be able to move to the US with my fiancee

Thank you. I hear you, its horrible when a parent act like that. Basically I stayed in the UK because of him and my son. I'm originally from Norway and came here to study, ended up meeting my ex and having my son who's now 3.  We were living with his parents when we had our son because housing and childcare prices in London are ridiculous but then when he started getting abusive and had enough and ended it he kicked me out. So I have no family support here, all I have is my son and my fiance. And at first we planned for him to move here, but because he's got a son to and paying an absolute fortune already in child support we would really struggle with the prices and wages in the UK.. I begged my ex to let me take my son because he's still so young and needs his mom but he just refuses and refuses to see that he would be so much happier in TN than in inner city London. My fiance says that we'll keep fighting for him once I'm over there because I can't mentally do it on my own anymore.

 

I hear you with the biological clock thing lol I'm turning 34 in November and my fiance is turning 29. I also want another child but I also feel like it's important that we get some time alone together when I first get there since we've missed out of so much time together already. Obviously it would have been fine with my son but a baby is a lot of work at first and I want him to myself for a bit lol but absolutely in a couple of years.

 

I'm sure everything will go ok for you guys! I mean there's no reason why you wouldn't get the K1. I used to worry about the visa not getting approved but then I'm so sure about our relationship that I'm not even stressing that part right now, all that is annoying and stressful right now is the wait but we will all get there eventually!

Straight answer: around two more months.

NVC to Embassy is taking a minimum of 3 weeks. Then it varies depending on the country specific process. Mine says wait for them to contact you, send documents, wait for them to receive them and allow you to schedule interview, do your medical before that, at least a week before... Kind of long, and of course it depends on availability for interview.

So yep, 2-3 more months.

And when you're alone it makes it easier for him to have control because you have no one to turn to. But things will turn out for the best just gotta believe that. And with your fiance by your side, it does make the fight easier to handle.

He genuinely believes that once I'm gone I'll probably get him within a year or so, once he gets over trying to "punish" me..So in the meantime when i get there I'm just gonna focus on getting a job, we'll go house hunting and just prepare for the future.

And you're fiance is right. He really doesn't want your child to live with him; he just wants to make you stay so you won't be happy. But once he has the full 100% responsibility on him 24/7, that song and dance will change. Trust me, doesn't matter what country it is, the situation happens the same way .

 

Yes, I will be attending with him. I'm hoping that by me being there the officer will say that he can come back and pick up his visa and brown envelope so that we can fly back together (as long as the medical is there in time). I've read in my country's portal that they do allow it to happen if they see the USC is present at the interview; they'll process the visa packet faster and we would have to go back to pick it up. If this doesn't happen, then I will have to fly back for the weekend to help him pack up so we can fly back together. But I'm also going because I've read in my country's portal that sometimes, if the officer doesn't believe or wants more bonafide proof of the relationship, they will reschedule the interview in order for the USC to be present. Although, I'm really not worried about proving our relationship is real. With the amount of proof I put in the packet, plus I plan going to see him 3 weeks, plus for his birthday in September, the embassy will probably get sick of us flooding them with proof. :P

 

Either way, we're walking this walk together so I will be present for everything.

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

Oh gosh. Im not alone with this custody thing. I have a 3 year old and the only difference is I think my ex says things to get under my skin, but he wouldn't win a custody battle anyway so I'm not too worried. My baby lives with me and I basically take care of everything,I'll never let her live with him,she's better off with me. That's why when she wasnt listed on the Noa1 my fiance called the CSC immediately ,but we got that resolved. I just have to walk on eggshells and watch what I say so there wouldn't be any extra problems with getting him to sign that letter. I can't leave my LO behind. It would kill me. Hope you guys stuff gets sorted out though.
