Friend of mine hasn't filed taxes in over 5 years and needs help

Friend of mine was married to a Pinay in the Philippines about three years ago. He's had some financial difficulties during that time period, works construction, and hasn't filed his taxes in over five years. He's found a sponsor that he is NOT related to and has the sponsors I-864 completed along with all supporting documents and signed. He want's to go ahead and send the packet without HIS I-864 knowing that an RFE may be sent. His reason being is he still hasn't filed his taxes and "thinks" he'll be able to get them in before this tax season. I've yelled at him way to many times about getting this taken care of BEFORE he went over for Christmas and so now he's there trying to get it all done now while he's there. Thank you in advance for any help!

He will need to file back taxes which can be done at any time and he does not need to wait nor should he wait to file them. For the 2016 tax year he should file he taxes promotly. He will get a checklist for the missing items.

He can do what he plans, it just means a delay due to RFE. There is really no point to send in the other papers, may as well wait and send all together.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If he hasn't even filed the I-130 yet, then he can go ahead and file it. It takes about 6 months for that to be approved. He could use that time to back file his taxes.

If he's already in the NVC stage then it doesn't make sense to only send the joint sponsor's I-864, they'll ask for his.

I should have added that the I-864 is the only paper work that is holding the visa up. He is aware that he needs to file the taxes. I guess the question is will his sponsors I-864 suffice and or take the place of his until he gets his taxes submitted?

No the petitioner is always the primary sponsor and the NVC must have his i864

Are you aware you cant just "file" the back taxes- meaning fill them out and mail them in, but you have to wait until they are processed and obtain a transcript. You can not attach copies of 1040s with w2s or Sched Cs if it is a late filing tax return. It must be the transcript.

This can take anywhere from 3-6 weeks to 3-6 months...
