I went ahead and mailed the 1040X just to be safe in case. I am aware that the return won't be processed by the time of June 04 consular interview. Best case would be that I might get some sort of IRS confirmation of the receipt that I can include along with the amended tax return and 1040X

 

BTW a lot of people have been in the same boat as me and ended up filing single. Some have filed 1040X and amended their tax return later on, while others have been bold enough and submitted tax return as single.

 

Like one guy said: "When my husband went to his interview, the officer didn't even look at my tax information at all. But I never heard anyone getting denied due to filing status."

Timeline

You can register with IRS online, and , your 1040x will show as received, waiting for processing soon.

Thus, this information together with a copy of the 1040x filed should be enough for presenting during the interview

IF the consular officer asks about it. If they don`t ask, than I would not bring this matter up by yourself.

Last one I saw: PD December 19th, 2016 on May 11th, 2018. I saw a couple here and there for later than that but not a lot. They are still working on December 2016 filers.

I have PD of Dec7th 2016.. no update yet !!

 

good to see Dec19th Approval...do we get an approval by mail or email ?

Hi guys. I hope you'll doing fine. Im wondering what is happening with the visa bulletin, does anybody have information or theories about it? 

 

I know we are all going through the same situation,  and it is very frustrating to feel like you are getting so close and then something like this happen. My pd is July 20. Does someone have a similar pd?

Within 1-3 months from an approval date, USCIS will send your case to NVC. Then NVC will send you a letter or email to notify you about your NVC case number.

 

You can ask NVC via this website: https://secureforms.travel.state.gov/ask-nvc.php

Provide your USCIS Receipt Number and all your information, email etc. then select the question "What is the status of my case?" or "Invoice ID" (if you want to know your invoice ID, this is your password to pay fee when your case is open in the future).

 

After 3-6 weeks, they will reply and provide your NVC case number. Moreover, they will save your email address, so they can send you the Welcome Letter when your case is ready to accept fees and supporting documents (1 year before the interview).

at what step do you apply for a EAD and 485 (upon priority date current)

1) right after receiving a i-130 approval ?

2) Once NVC Confirms they received the case from USCIS ?

3)when case is ready to accept fees and supporting docs?

Hi @helloharsha,

 

You do not need to apply for EAD and I-485 if you are going via Consular Processing (Which is what NVC handles). What you are saying are steps for Adjustment of Status, and for that the beneficiary must be inside the U.S. and with a legal status at the time of filing. For Consular Processing, you must wait until you receive a Welcome Letter from NVC to proceed with the information required, in that case you will never have to apply for EAD and I-485.

March 2, 2018: AOS Package PD (I-485, EAD, AP)

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand
