Hi Jamie, Thanks for your reply.

Well a couple of things the USCIS doesn't care what your state laws are. They go by federal law. As long as you are legally annulled and he is legally divorced in Chile and can provide evidence that he was PRIOR to the date that you filed and signed the I-129F petition then I don't see a problem. What is the 6 month waiting period? It means someone has to wait 6 months after they are divorced before marrying again?

Even if this was the case you can expect minimum 3 months for the K-1 and then when he is here you have another 3 months to get married so that would be 6 months. I'm not really sure I understand what the 6 months is all about though for you concern.

I sure hope they do not care what the state laws are. We both are legally able to marry and we provided the evidence of the sentence signed by the Courts and the judge for the divorce for my fiancee :)

You are correct about the 6 month waiting period, many states have a "waiting period" that states that you have to wait a certain number of months after a divorce which is always put in the divorce sentence provided in that state, but only my state states that you and anyone else that had a divorce must wait the 6 months.

That's exactly why we sent it now, because we know the rules, we will follow the rules but we didn't want to wait until April 2017 to send the petition. I hope it all works out for the best!

On another note WE RECEIVED OUR NOA1 THROUGH TEXT MESSAGE! I am ecstatic, I knew today was the day, just had that feeling! :thumbs:

The case number starts with WAC which means its being transferred to the Cali SC?

JimJesDuna, I was able to find Cuba for the "Beneficiary's Country", but could not find it for the "Consulate" or "US Embassy".

noa2 is now 20 - 30 days avg but some take longer than others , nvc is 2 - 4 weeks avg, RFE fixes 2 weeks or more depends

no guarantee , k1 takes 3- 6 months on avg , longer for some who have issues and hiccups or get stuck in nvc or uscis limbo

Question! Thinking ahead! Once you get to interview stage do you arrange your own date for interview or are you just given one?

It depends on the Embassy.

For example years ago if Manila they would schedule for you.

Now you schedule your own.

I am the beneficiary, but I'm in the U.S. with her until Jan 9, and I really hope we'll get NOA2 during that time...

You guys are lucky because you are together. I haven't seen my fiancé for 5 months already :( She's suppose to go home last October but since she got a new job company policy states that she cant file a leave yet until she finishes her probationary period of 6 months.

After calling a couple of times, finally somebody had the good grace to tell us that they didn't have it and that our best bet was to refile. While that's really annoying (and also ridiculous), I just hope that it works out this time. But at the very least, we're already a step farther this time.

Welcome to the thread. Sorry about your past troubles. Hopefully they didn't make you pay twice.

According to your VJ Timeline based upon your NOA 1 (date on your NOA Hard copy) you may have an approval estimated at Dec 14th at the latest.

That is 30 days from today.
