K-1 or what can other process i need to do?

My girlfriend want me to move with her


We've been together at like least 2 years, we've been studying together for this 2 years in the same art college, both graduated from the same school. We meet each other in the first year of college and now we were here 2 years ago. Now she is moving to Florida and she wants me to move with her, but I'm not an American citizen like her, I'm from Dominican Republic.

Now I'll come in October for her birthday. The question is, how can we do in this case for her bring me up to the US (Florida); what process we need to do?


Excuse me if I have a bad English I'm not writing too much in English because I use more my first language (Spanish)

I'm in the Dominican Republic and She is in Florida Yes, we both want to get married

i forget that I have a 10 year Visa, I've been travelling a lot to theU.S. (Florida and New York) because I have family there so every summer or Christmas I come to visit my cousins and some other friends that I have there. Now I'll come in October for her birthday. The question is, how can we do in this case for her bring me up to the US (Florida); what process we need to do?

You basically have two options: the Fiance K-1 Visa (which means you will travel to the US and marry her in the US) or you can get married (either in the US or in the Dominican Republic) and then apply for the CR-1 Spouse visa. CR-1's are a little more straightforward, K-1's are a little trickier and have some extra expenses and steps. That's the basic difference. That said, a lot of people do K-1 and everything turns out fine, just depends on what you think will be better for you.

Whoops, forgot to add: Do not travel to the US on your tourist visa (or whichever non-immigrant visa you have), get married and adjust your status. That will be seen as visa fraud and it's a big no-no.

Although DR is considered high fraud...if you have proof of a relationship pretty quick to get it :)

My fiancee arrived today...our only hold up were march was delayed due to processing delays and my fiancee has 32 day AP after approval...routine name search....

In all inhad a good k1 experiance moves pretty quick too ;)

We want to get married soon, but now I'm going to Florida to visit her and talk to her personally about this subject and then get in the process, I think that my visit with my tourist visa now in October can't bring problems or you think will do?

I'm thinking about telling her that K-1 would be the best option we can choose in this case.

I think I have very much proof to do that, all these 2 years studying together and living in the same college and my visit for her birthday now in October, Skype calls, letters, presents, photos (with her and with our friends).

If you know some more ideas of proof that can help me, please tell me about it because I really want to be with her.

Well honestly i sent my passport like 100 pictures although they say 5 and i went 3 x this year alone...

I didnt send any chats or emails although people do....insent really detailed intent to marry letters. And this was my second k1 so i had red flags.

I also went to my interview i feel this helped i was asked more then him. Also i had real personable answers i am very talkitaive i described how my fiancee helps me on the day to day how i respect his opinion...in all he can see the love there.

I have hundreds of pictures all different clothes too not of the same day....i sent pics en la cabana lol but not nude but very indicative of a relationship ;)

Just be genuine you should be fine ;)

I would write a nice letter and boast on the fact you have a visa but wanna do things the right way...they can see anyway but that looks good ?

Also since you have such a long relationship send them a nice timeline (L)

Keep in mind that k1 take a while to be able to work and travel outside the USA. If you want to work and help with expenses after marriage, you'll have to wait to file the adjust your status ($1070) and wait about 90 days. It can take up to a year to get the actual green card.

I would like to draw to your attention that while you are set to visit her this October, please don't take any material (Copy of any forms I-129F, I-130 etc) with you. I distinctly remember reading about a case here on VJ, that the person was denied entry because they found the copies of documents and form in his backpack.

If anyone remembers the case, please provide the link for that topic.

06/01/17 -- Medical Examination [Complete. It took around 2 hours. Total Cost INR 11650 for Surat City Apollo Clinic]

06/12/17 -- Biometric (OFC) Appointment

06/13/17 -- Interview [7:30 AM at Mumbai, India]. Visa Approved

06/15/17 -- Visa in hand

06/21/17 -- POE at DFW (Dallas, Texas)

Removal of Condition (I-751) [Approved]

06/18/2019 -- Sent the package (3 Days before GC expires, cutting it close). Sent to Lewisville, TX via FedEx Ground

06/19/2019 -- Package received at around 9:30 AM (Hoping I don't get rejected for missing deadline)

06/24/2019 -- Card was charged with $680 fees. Text Message received confirming Receipt. Case routed to NBC (Case Number starts with 'MSC')

06/28/2019 -- NOA Hard Copy & 18 Months Extension Letter Received in Mail with NOA Date as 06/19/2019

07/12/2019 -- Biomentrics Appointment Letter received. The Letter is Dated 7/5/2019. Appointment is on 7/22/2019

07/22/2019 -- Biometrics Appointment Complete

02/01/2022 -- Interview Scheduled for 3/3/2022 (combo interview)

03/03/2022 -- Interview Complete. No new Green Card will be produced as my Naturalization was also approved.

03/04/2022 -- USCIS status changed to approved.
