Original K1 Application Reaffirmed at USCIS

I just received notice that my K1 case was reaffirmed at the USCIS and sent back to the department of state.

I am assuming it goes back through the NVC stopover as the original did.

What are the steps once it goes back to the embassy? New interview? New Medical?

Once reaffirmed is it looked at harder by the CO or is it already had the hard look and survived? It was sent back for an IMBRA clarification. I am shocked it didn't die at the USCIS.

Any information is appreciated.

are you waiting for your approval letter (NOA2) or are you past that point? I'm looking on your timeline - so if its not accurate plz consider updating it.

If you have already had your interview - what was mentioned? Did they tell you they are sending it back to USCIS? Did you find out the reason for their decision? Who did you get involved to have the embassy consider a second review/interview?

I ask cuz im in the same position and would like to know that I also took all steps necessary that I could possibly take....

I apologize for the goofed up timeline.

My case went all the way up to interview. 221 g then sent back to USCIS for IMBRA review.

Sent letter to withdrawl original application and started a new one. This is what the timeline reflects now. Then Low and behold USCIS reaffirms the original and sends back to department of state.

Had senator involved but only with embassy and AP review.

This just happened. I thought it was expiring and dying a slow death.

I guess they do come back from USCIS reviews.

oh interesting....what was told during the interview - need more info? sorry but your not approved? did they ask for the passport at all? was the 221g marked at all? how long did it take for USCIS to receive it and contact you regarding reaffirmed? I didn't that that was possible with the K1's...

Interview was may 9 th. USCIS got it back in late July / August. Reaffirmed on September first.

I heard it could happen. Seems rare on a k1. 221 g just said administrative processing. Stayed onAP for 45 days or so. Then returned for IMBRA clarification.

So USCIS has approved it twice to this point.

First reaffirmed K1 I have read about in about 9 years here. Last ones came through Vermont and definitely not CSC.

Yes, it will go through a short NVC stop and gets routed to the embassy from there.

From your dates you posted a new medical should not be necessary.

No one can predict if there will be a 2. interview or visa issued without one.

It almost makes me think the USCIS IO was a rookie and made a mistake to re affirm it.

Wow, thanks for the update about it. I also find it interesting that is was reaffirmed and returned to the consulate. Keep us posted as to the process and outcome. Good luck!

Actually the reaffirm policy changed about 8 years ago. Used to be the east coast would review the K1 and the west expire it ( back from our first K1 filing ) and then 7 years ago both went to expiring the K1.

So, you sent in a letter to close your original case, then re-applied and THEN they reaffirmed the original yes?

It's possible that you sending in a new application triggered it being reaffirmed. Maybe a case of someone seeing that it was already in the system and just going with that one instead.

Either way, you -shouldn't- need a new medical but you never know, there may be another interview though.

Yes. On July 18 I sent a letter of withdrawl. On August 23 I got an NOA 1 for the new petition.

The officer I spoke with took some offense and the return and die comment explaining why I did a new petition. She said that a blanket no reaffirm was not a policy that it's a case by case review.

I checked regularly on the old petition and it never was cancelled. Then yesterday it showed reaffirmed on the 1 st of September.

I called USCIS and they don't have a record of the withdrawal. Thank goodness. They withdrew # 2 while I was on the phone with them since the new package had a copy of the withdrawal.

She said everything is good on the USCIS end. Wished me luck and asked if she could help further. Now we wait to see how it goes on the embassy side.

Medical was done in May. Police was done in April.

Wonder what she will have to do once it's received by the embassy.

Actually a reaffirmed petition is better than a new one. Reaffirmation means that USCIS is telling the embassy they got it wrong and try again, to deny they would need strong concrete proof that something was wrong.

Im going trought the same thing, after the interview at the consulate was given the 221g,  and case being sent back to USCIS, how long from that to the visa on hand did it take four you? thinking about flying to Mexico and just get married if is going to take the same as the first part of this nightmare.
