Hello! I am ready to petition my two sons here in the US. I am still a 10 yr GC holder. Can anyone here please send me a link of things I have to do or to paperwork to be filed? I would like to know the time frame of processing the papers too. My eldest son is taking Mechanical Engineering and his in his third year right now. We would like like for him to finish his course before coming over here. Is there any grace period when to fly to the US? Thanks in advance for those who are replying.

They have about 2 years wait - you need to start by filing I-130 petition for each of them.

Thank you all for the response. They are 17 and 21 yrs old. From the time they get there Visa, do they have to fly here right then or does it have a grace period when they can fly here? Thank you very much

They will have 6 months after their medical to fly here. However, 21 year old (of he is 21 and not 18) has 10 year wait do I wouldn't worry about grace period at this point...

they will have up to 6 months from their medical to come, the visa will have an expiration date, they must enter the country before the visa expires

also, since they are under 21, the process will take 2 years, but you must file immediately, especially so the oldest one has a chance to file and get the visa before he turns 21

You have some time but not much. You have to get each application (I-130) in soonest. Obnce it's accepted, the time is just waiting. It could take several years to get them here. No worries though, Since the paperwork had been started before they reach age 21, they should be ok. Each one will need their own paperwork started, just follow the guidelines on the immigration website. Best of luck

my friend was almost 21 before she got her visa (3 months from 21st birthday). So her visa was valid for 3 months NOT 6 months. And it was expiring 1 day before her 21st birthday.

So hurry up and start right away.

Get them here ASAP. If they need to finish schooling, etc., once they are here you can apply for a re-entry permit and they can leave for up to 2 years.

But they must make it to the US on their immigrant visas before they turn 21, otherwise it'll be 10+ years of waiting.

Paperwork started before they reach 21 applies to children of USCs. In OP's case, these are F2A cases, they have to enter the US on immigrant visas before turning 21.

OP, are you still married to your USC spouse?

If you are, it's quicker for him to file for them as his stepchildren.
