Advice regarding confusing situation. in ir-1/cr1

Hi everybody,

I want to know about one more thing .my wife which is currently in us and already sent my i130. She wants to visit me soon as well in India on our marriage anniversary in july , and I was bit stressesed and confused like if she got pregnant which nobody knows in case and after that she travel back to us . what's gona happen then can I get my tourist visa in case if spouse visa process gona take long to take care for her and our baby .and what legal responsibility I gona come under as I am not aware of us laws she already HV a kid with her ex, will I have to financially support her kid from her ex as well in future? Or do I have to still complete this spouse visa process if she gets pregnant here and give birth to our baby in US. Can I get emergency or any kind of visa if she gets pregnant and goes back to us.

Awaiting you kind advice friends its confusing and bit stressed for me .

I had a friend who got pregnant while in Morocco and she was a USC. She still had to file the I-129F and wait as long as everyone else. Their process took about 11 months and by that time the baby was already here. They don't give any special treatment because your spouse is expecting. As for a tourism visa, you have to be able to prove strong ties to your country. If your spouse is pregnant and you are already planning on coming here on a different visa, I can almost guarantee they will not give you a tourist visa, because they will assume you have no intent to return to your country. (Even if you do) As for her having a child with her ex, that's a bit of a confusing subject. Do you have legal obligations to fulfill for financially supporting the child from her ex? No. You don't. Im not too familiar with the type of visa process you are going through, so hopefully someone will read this and correct me if I am in any way wrong.

You can apply for a visitor visa.

Pregnancy is not a reason for an expedite.

does your wife have custody, full or part-time, of her child? Because if the child lives with you and your wife at all, he/she will be eating dinner with you guys, will be on the insurance of some one, will need clothes..... I guess you and your wife can keep all of your finances separate, but that may cause issues when you Remove the Conditions on the Green Card. I'm no expert, and I'm not a lawyer, but I have several friends who help take care of their current partner's kids from their ex's. This should have been discussed prior to marriage.

i dont have any issue with the cloths and foods for her kid from her ex but i was thinking like in future like she can ask financial support from me for her kid with her ex. and secondly which legal liabilities i gona come under if she gets pregnant here and move back to us coz i am having trust issues with her can she ask legal financial support from me if will be in India and she will be in us can i get bounded with any laws just wanted to know for my knoweledge.

That's why I stated it was a "confusing subject." I have 4 small children with my ex. My fiancé and I discussed all these things before we started the k-1 process. He asked me if he would have any legal financial obligations to my children, in which I stated no. Their father is responsible for that. BUT I also explained that when my kids are with us, we will be married and will have to financially support the children. Food, clothes, college tuition, all the fun things that come with having children. He knows he's coming into my life as a stepfather to my kids, and he's not legally obligated to do anything, but fortunately he loves me enough to take on and help with the obligations I have to my children.

Unless you adopt the child from her ex, no, you're fine. As for supporting a child that is yours, if you're there and she's here.... It's possible.

It sounds like you don want to put a dime towards this kid. Does your wife know how you feel? You guys are going to be a family! Idk what you think but that child will be your kids sibling!

married, having trust issues, planning of getting pregnant and still moving to the US? Shaking my head right now..

If you are in India she cannot oblige you of anything, US laws is US Laws. Now if you are already in the US and you as a husband has legal responsibilities on your wife and biological kid. She can demand spousal support and child support in case of divorce; that is of course based on your financial capabilities..

There's no expedite for pregnancy. If you're worried about supporting your child from abroad, I suggest you take the necessary actions to avoid pregnancy when she visits you.

I should have said, "anything is possible". Getting child support from a foreign parent in another country would be very difficult. I've heard of it maybe 1-2 times in my life, but I would hope that if you fathered a child, you would do what you could to support him/her regardless of where you were. Best of luck!
