Where do I start? Minor brother of immigrant husband

So could you all please point me in the right direction?

My SO (who is a green card holder and will apply for citizenship next year) has a minor brother with dual citizenship for UK and Egypt. The boy will be turning 16 in a few months. We would like for him to come here and attend high school for a couple years and after that he would of course be on his own to manage his college applications and visas from there.

What sort of options should we be looking at? Where should we begin our investigation?

Timeline

He would need an F1 visa and proof of funds to pay for school. He would not be able to come and stay with you and attend the local public schools for free. They would also charge tuition.

Probably best to wait until your husband gets citizenship first then apply for his brother.

It's very expensive to pay for school and you may want to look into which school he wants to attend so you can get an idea on costs.

He can use VWP to study short course for up to 3 months without a visa though.

Hmm.... Yeah, if it was early in his schooling waiting until next year for citizenship of my husband would make sense but due to some situations back home it would be better if he could join us sooner than later. Money is not an issue at all for tuition or otherwise.

Can he come on a student visa?

I guess F1 is the requirement for a student to travel here for a year. Can it be re-applied for after a year for a high schooler? I just buzzed through J1 information-- guess sponsoring an "exhange" student doesn't work out to well for relatives. This sort of feels like an uphill battle to manage by Aug 2016, but its worth a shot for the kid's sake. A visitor visa wouldn't work either I suppose. I'm not sure if high school is considered "for credit" education. It wouldn't be that difficult to have him leave the country and come back on holidays, but I am guessing high school is not allowed on this type of visa.

And for family immigration purposes-- I couldn't sponsor him myself as his aunt? Do I have to be a biological relative?

Only sibling and those take over 14 years To attend school legally he must NOT use a public school without paying for attendance ( most schools wouldn't turn him away but it would cause him future headache in getting another visa until the unpaid fees are paid and recently has been coming up as an issue for parents ) private schools exist, you need to find one that will issue him an I90 Expect the fees to be about 15-20 a year.

This will not be over quickly. You will not enjoy this.

Like I said-- money is not an issue. Tuition is not an issue.

The issue is visa more if there were any other options besides a one year visa-- and if its possible to reapply for a 2nd year the next school year

Yes F1s can be renewed, but there is no guarantee it will be, especially for high school (it usually will be for college courses where the course lasts 3-4 years). An F1 student visa is supposed to be for the student to learn english/ experience life in a different culture, and then go home after a relatively short time, and this does not seem to be the intent here.

As a side note, you say "due to some situations back home it would be better if he could join us sooner than later."; if you need to get him out of a home that is a danger to him, then a boarding school in England may be the best short term option.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Here are the words about F1 students in public school

Public K-12 Schools

Local, state and federal tax revenue fund public schools. An F-1 student may attend an Student and Exchange Visitor Program (SEVP)-certified public high school (grades nine through 12), with certain restrictions:

  • For a maximum period of 12 months – This time limit includes all public schools the student attends. You cannot spend a year at one public high school and then transfer to another.
  • Must pay the full, unsubsidized per capita cost of attending the school district. Payment of this fee must occur before the child applies for an F-1 visa. You must be able to present proof of this payment is at the visa interview and at the port of entry when you apply for admission into the United States.

This will not be over quickly. You will not enjoy this.

Plus, he will need to be able to convince the visa officer that he has no intention of remaining in the US, that at the end of his studies he will return home. Not sure where he is living at the moment, but if the reason he needs to join you is that you need to become his primary caregivers for some reason, that will be a difficult hurdle for him/you to jump, since you seem to indcate longer-range plans for him to stay in the US.

The situation is not relevant at this point to what I needed to know so I will not get into it. Getting a minor brother in law to high school here in the US under our supervision when money is not a concern is my objective and I have some good information for a starting point, thanks to VJ. :) I appreciate all those that stopped by to chime in.
