Can my hubby visit the US????

Hello! I am an American citizen married to a Czech citizen. We are in the process of applying for his immigrant visa and green card. We have had out I130 approved, but are waiting to hear about the Affidavit of Support approval. He has been denied a tourist visa before we were married and is no longer eligible for the ESTA visa, but we are wanting to go visit my friends and family in the US. Is it possible to re-apply for a tourist visa while we are in the the middle of dealing with the immigrant visa? Would he be able to come with me to the US embassy in Prague to ask and reapply for the tourist visa? We are able to prove strong ties to Europe, and have no intention of immigrating to the US immediately.... any help would be amazing! thanks!

Yes, you can apply for a tourist visa during the visa process. Whether you'll get one or not is another story, but applying for a tourist visa won't hurt your visa case.

Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

So your petition is at NVC and you submitted your IV package and AOS package and submitted the DS-260 online and now you are waiting for Case Complete?

When was your scan date?

I asked because you could be getting a May interview and by the time your husband has tourist visa interview he may have the IR1/CR1.

And it's hard to convince the CO that you don't intend to immigrate when that's what you are getting ready to do.

But doesn't hurt to try.

Yes, he can apply. You can't really do anything to make it "easier." He would have to prove that he will return home after the visit. At this point his ties seem to be stronger in the US than outside. To know for sure submit the application and have the interview.

well we both have great jobs/house/cars in Switzerland.... im confident we have enough proof!

he overstayed a canadian work visa, and was paroled into the us, then had to leave in a certain amount of time. because of that he cant get the visa upon entry anymore. He had applied for a tourist visa in the past and was denied because he couldnt prove enough ties to home. but now we have been living in Europe for 2 years and have established ourselves here after a lot of traveling....

Sounds a very long shot with that history. But no harm trying.

But you are getting ready to give all that up in the relatively near future....hence, the immigrant visa application for which you are almost ready for interview. The interviewing officer will have that information, which will make it an uphill battle to convince him/her that you ahve strong reasons to return to Europe. They could well assume that, since your I-130 has been approved, you will just short-circuit the visa process and apply to adjust statau in the US. Given that he was refused before, it's an extremely long shot that, given the IV application that is almost ready for interview, that they will grant a visitor visa at this point.

All of which you're about to leave behind and move to the U.S. If it wasn't you and someone was telling you this would you grant them a visa? All the proof you're going submit to prove you must come back are the very things you will soon leave behind.
