K1 valid to august, NOA2 expired. Is this an issue? Can I be send away at the airport?

To clarify the point sometimes embassies will erroneously give an interview after the NOA 2 expiration date....making the visa invalid. That's when CBP will turn you away for having an expired petition, just make sure your interview date is before the expiration date, or that they extend it out until your interview and you will have no issues.

That's a fact and the stories that have been told have been led back to that.

They almost didn't let me in, because the doctor that did my medical wrote the date I went to do the medical where the expiration date is supposed to be. I had to wait for a long time at the POE and finally they let me in. The officer must have read the documents very well to catch that. THe embassy never said anything about it.

If you read the previously posted thread link you would know that it did in fact happen. Rare but it happened.

Some CBP are a mess on regulations within the law and do what they want.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It's only possible is for some reason your interview was after your NOA2 date and visa was issued after without the embassy extending your NOA 2 date. Sometimes embassies forget or don't extend and will erroneously interview and subsequently issue out a visa after NOA 2 expiration. Rare and even rarer for a CBP to catch it.

They won't do it if you've already had your interview or if your interview has been scheduled before the expiration date.

Thanks for enlightening me :) It make sense now! If the visa got approved & issued before NOA2 expiration date means US Consul will not extend the validity of I-129F therefore the CBP officer has a right to deny you at the POE even if the K1 visa is still valid because it has been issued before your NOA2 expiry date. OMG Seriously?? I have my interview last January 11 and my NOA2 validity is until January 1. Of course I didn't just expect the embassy to extend my NOA2 validity, I emailed and called them; they formally emailed me. I will bring that letter from the embassy for my extension at POE.

My fiance was majorly hassled about this when we arrived at the Atlanta POE (this is normally a very busy airport with a low harassment level -- or so we thought). It was Christmas day (December 25) so I am assuming that because it was a holiday, the newest, most junior CO was assigned to work on this major holiday.

He saw both the "PETITION expiration date" (which was Dec. 1) and the "VISA expiration date" (sometime in the spring, like April or May?) and said there is a problem with my fiance's visa. I stood up for my fiance and explained to the officer what the petition date meant (why they even put that on there, I'll NEVER understand, because it is confusing if you're not familiar with what goes into earning a K-visa). The officer said "well, I'm going to have to try and find some answers here, otherwise we have a problem with this visa".

We waited like 30 minutes when finally he cleared us. Another officer had to assist him, but it's really scary when you've come that far only to have the discretion of the CO be the only thing between you and your future in the US.

I just got a phone call from a very nice lady from the consulate. She said she had never in her life heard a story that someone got send away at the airport. But we all know it's a fact, very rare, but it can happen. She send me an email that explains the K1 process which I'm bringing with me to my point of entry. I hope that the CBP officer will be competent though and knows his job.

Damn... I see youre from the Netherlands too so we probably had the same doctor. That is scary. Did you have the old or young doctor? From what I understood the doctors office is run by a father and his son. I might have the same issue then... <_<

I am also concerned about this as well. My Fiancé just had her interview on Monday in Tokyo, but just realized that she needed a Canadian Criminal Record check as she was there for more than 6 months back in high school. They are allowing her to send in this record along with her passport and said they will then provide the visa. How can I be sure the date of the NOA2 won't be expired in this case?

Because the interview was before the Noa 2 expiration date.

I believe it was the older one. I don't remember exactly because it's been a couple years ago. The doctor probably wasn't paying that close attention when he filled out the papers because he left the other line blank (the one where he was supposed to write the date of the medical)
