submitting new I-864 form after receiving checklist (merged topics)

Hi guys,

We got a checklist due to the incompetence of our lawyer. She sent an expired i864 form. She said she would contact us last week to see what we have to do (we know what we have to do) and we are still waiting...

Sooooo...

Husband and I decided to answer to the NVC checklist on our own instead of waiting for the lawyer.

There are a few sections that do not apply to us (additional family members immigrating with me, Elis number, interpreter information, attorney information, etc.)... We want to avoid another checklist and are wondering if we should just leave those fields and sections blank, or if we should basically fill the entire form with None or N/A whenever something does not apply to us and/or we don't have the info (I.e., I have no Alien number).

Have you been successful either way?

Hi

I will be resubmitting the i864 to NVC as I got a checklist for obsolete form.

Can I send only 2014 taxes or should I send all 3 previous years? Husband was not required to file in 2013, so I don't have anything for that year. I also don't know if answering YES to the statement saying I filed for the last three years, or say NO and explain at the end of the form.

Hi! I'm sorry to hear that. It's not acceptable that people you hire do such mistakes.

I would recommend you after filling all the information print your affidavit form and put an EVERY blank field N/A using black ink. This is what we did and we didn't get any check lists. And double check that all fields are filled because sometimes after printing some fields that you filled electronically don't show up (it's pdf files problem). Last pages about an interpreter and preparer and additional info must be included as well. Just put N/A everywhere. Don't forget to sign it and put the date. Send the original to the NVC. Answer "yes" if they have filed tax returns for the last 3 years. Answer "no" if they have not and then include an explanation as to why. Earning less than the required amount for filing would be a valid reason.

I know, it was really frustrating to hear that, especially when I realized the new form dates from July 2015 and these people sent it in October. How can they be so careless?

Yes that's exactly what happened. He almost didn't earn anything due to being in Mexico with me and having a super hard time finding a job.

If the sponsor is the one filling the i864 is it OK to put N/A's throughout part 10 of the form? I know that this section is all about information of the person filling the form IF other than the sponsor.. But I am asking because I know NVC can be tricky.

yes, that is for when you have a lawyer or visa preparing service fill in the form.

i left them blank so guess it depends on the person reviewing the form

My lawyer actually sent copy of marriage certificate in ( paper in Morocco is slightly larger) and NVC said send in original / needless to say i quit depending on him for anything

he had all originals

After this i handled all even the appeal on my own

As you know I am about to resubmit i864 after a checklist for outdated form. As the lawyer filled it with errors and omissions, I want to do it right this time, with your help.

I have a few questions on part 6 and here is my situation:

Husband (USC) filed taxes in 2014 and 2012. He did not file in 2013 as income was zero. I will have a signed statement to send along with IRS Publication 501 as evidence that he was not required to file.

Now... My questions...

Question 18a says Have you filed a federal income tax return for the last three years?

I will answer NO and explain why in Part 11 - Additional information.

Question 18b. Marked as optional says I have attached photocopies or transcripts of Federal income tax returns for second and third most recent years.

I will check this and explain in Part 11 that I am attaching 2012 and an explanation statement for 2013 with supporting evidence.

BUT for Question 20. "I was not required to file a Federal income tax return and I have attached evidence to support this"

What do I do? Does this refer to 2014 or to any of those 3 years? If it refers to 2014 I should leave blank but if it talks about 2013 or 2012, I should check this... Correct?

I think you may have to call the Embassy and ask, to see if they can help you with that question. Just say you are preparing your documents and would like an answer (they may or may not help you). I would check and attach a letter explaining everything (like you mentioned) with all the documents. Also I may suggest finding another sponsor for Plan B. I'm still under "AP" at the embassy because the CO would not accept my current income and I had to find another sponsor. Good luck to you!
