It depends. If you are a US citizen, they will process the petition in a heart beat. If you are a LPR then you have to wait for your priority date to be current. Table B refers on AOS filing.

True, but according to the description of table B if someone is in the US with a non-immigration visa he/she can adjust the statues in US. Consequently will have a temp work/stay visa until the priority date becomes current.

Yes I am going to try my luck on 1st Oct. But my visitor visa expires on 21st Nov. Will I be able to stay until a decision is made for I485 and my EAD card till that time ?

Just filed I-130 under F2A on 09/14. Got NOA1 on 09/21. And the wait begins..

Just worthwhile to check if I-130 approval is a prerequisite for I-485. Even if it is you hopefully will get your approval before 21st Nov.

You can only apply for I-485 (also known as AOS) only after I-130 is approved (this is assuming the petitioner is LPR and not US Citizen).

Just spoke to my attorney, and he said it is a bad idea to have your spouse fly in on B2 visa and then apply for I-485. Better to wait for Consular Processing just to be safe (My wife has a B2 visa and lives in Canada)

I believe it is not a good idea because B2 visa is supposed to be for visiting US as a tourist. Filing for AOS while on B2 visa means you lied about your intent to visit US, as your real intent in this case would be to file for AOS and not be a tourist.

Unfortunately, for cases like mine where the spouse is outside US, the new Visa Bulletin does not help in any way. It is only useful for beneficiaries who are already living in US not as tourists (such as F1, H1, H4 etc..)

If i130 is pending but priority date is current, one can file i485 with the copy of i130 receipt whether the petitioner is LPR or US citizen. Even on i485 form, it has that option to check that criteria in eligibility section.

Since this new bulletin provides new filing date of i485 for F2A, one can file for i485 with pending or approved i130 if the priority date is earlier than the filing date on the visa bulletin. That is the benefit of new visa bulletin for F2As.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

I called NVC today again and got thru it after several tries. The person from NVC told me that they have just received my case on Sep 23rd and a case number hasn't been assigned yet.

At least happy to know NVC received my file.

2015-09-23: NVC received file
