Will I get delay for sending n/a docs for AOS?

Hi All, I am going through the post package submission anxiety phase and I think I have found a grave mistake. Please advise.

I read through the instructions for I-864 EZ and at the end there is a section titled Checklist. This part confused me. It stated that everyone needs to provide tax returns and w2's. I was able to get a tax transcript from the IRS online and send that instead of the returns so I didn't think I needed to send the w2's. After reading this dreaded checklist section I decided to send a copy of my w2 for the recent tax year just in case. Low and behold, after mailing that in I reread the instructions and it explicitly states NOT to send in the w2 if you are using the tax transcripts. Sigh. Did I just cost myself some delays for that? What can I expect now? Thanks in advance for any replies.

They tell you not to becaus they don't need them. Just think for a second what kind of delay would it be?....sending back you application to take them out? Making you resubmit without those in there? Neither one makes much sense....I understand the worry but you're fine.

You may not be " fine " if what we see in other cases where this mistake was made. Providing incomplete info causes USCIS to set the case aside until the info is complete resulting in an RFE.

If you have filed your 2014 taxes you can request a transcript within a few weeks of filing. If you haven't you will have to wait until you do to request the transcript or you can prepare a complete copy of the tax filing that you can submit when you get an RFE.

You may not be " fine " if what we see in other cases where this mistake was made. Providing incomplete info causes USCIS to set the case aside until the info is complete resulting in an RFE.

If you have filed your 2014 taxes you can request a transcript within a few weeks of filing. If you haven't you will have to wait until you do to request the transcript or you can prepare a complete copy of the tax filing that you can submit when you get an RFE.

They did include include their transcripts though, just happened to also put their w-2 in for the most recent year. How is that leaving anything incomplete?.....it's too much information.

Did you send a W2 for the same transcript you had sent? If that's the case I wouldn't think its an issue but if you sent W2 for the current tax year and you had not sent the same transcript they will need more information for that W2.

There is nothing incomplete in this particular circumstance. W2 was simply a supplement to a properly sent return\transcript.

In my non-expert opinion, OP should be ok and not get an RFE for this particular issue.

There is nothing incomplete in this particular circumstance. W2 was simply a supplement to a properly sent return\transcript.

In my non-expert opinion, OP should be ok and not get an RFE for this particular issue.

I a very recent case here on V J exactly the same thing happened. The result was an RFE for the remaining tax info.

The W 2 isn't viewed as a supplement, rather incomplete info that wasn't required which also makes it appear the person could file the taxes.

I guess they need to answer if they filed taxes and sent a transcript for this year (2014) and the W-2 in addition or if they only sent the W-2 for this year and no script or copy of return. I, as others have, read it as they sent a transcript for 2014 but also sent the w-2......guess it depends on how we take the statement.

So are we saying.. and I'll try to be clear with my phrasing to get my point across.. petitioners should EITHER only send a tax transcript (which then presumably is the entire tax info NVC cares about) OR if sending a W2, it should be accompanied by the tax return?

I am unclear on the potential for the RFE.

You are correct.

The thing here is we know they didn't send a tax return for 2014, but they did send a W-2. If they sent a tax transcript for 2014 they're good because the W-2 is extra. If they did not then RFE because W-2 alone is incomplete.

Thanks all for the replies. Yes I sent the tax transcript for the recent tax year 2014 and sent the same year w2. According to a NVC representative, the w2 will be disregarded since I sent the necessary transcript. I hope that is the case. All I ever wanted was to avoid a checklist. That got me so emotional I made a stupid mistake. I wish I had not sent it but I just have to wait and see and face the consequences.

Because you sent the tax transcript you are fine. the checklist for another person was sending the w2 without a return or transcript.

Please everyone though, keep in mind that if you send a tax return transcript there is zero need to send the w2 or the tax return. That is the point of the transcript. A w2 does not prove current income. Paystubs and/or an employment letter does that. Imho, paystubs does it better.
