I'm a military and stationed overseas. I'm on the process of completing the form I-129 but not sure what to put in question #28 (Address in the United States where your fiancé intends to live) since I'm not currently in the US and not going back until 2018. What should I put?

If you are not going back until 2018, how are you and your fiance getting married within 90d in the US?

The visa, upon approval, is valid 6 months - meaning the foreign fiance needs to pass the US border in that time and gett married no later than 90d after. Where will you and your partner live?

i was told that since i'm military and stationed overseas. They said that the base is considered US soil.

He is in the Philippines and i'm stationed in Germany. I'm trying to petition him to be with me in Germany until my tour is done and then bring him with me to US.

Make sure that you are using the correct form.

I-129 = Petition for a Nonimmigrant Worker

I-129F = Petition for an Alien Fiance(e)

Hi.

Put your address in Germany, you are there long enough, that it is where you will both live, you are correct, it is considered US soil. If you need more clarification or guidance, USCIS has a military help line you can call: http://www.uscis.gov/military/military-help-line

FYI - this is also a military sub-section on this forum, best to put these questions in there, there are often many people who have been through this situation already.

Interesting. But wouldn't it only be considered US soil within the US base? I mean, you gotta leave the base sometimes to live?

Hence, your Filipino fiance runs into German immigration problems? I mean, upon approval, if your fiance is to live with you, s/he has to cross the German border who do not give a damn about US K1 visa...

Fingers crossed, your military affiliation will make the process smooth for you!

I have never heard of a K-1 visa being used this way. A US military base is considered US soil, but it is not considered entry to the United States. If someone was going to a US base abroad, they would be entering the country in which the base is located, and go through that country's immigration/entry screenings to be admitted there. A US visa is only used to enter the US.

The K-1 visa must be used to enter the US and marry in the US within 90 days of entry. You would then need to file for AOS to become a permanent resident of the US.

Possibly. However, bear in mind that your issue won't be US immigration rules, they will be German immigration rules if you intend your spouse to come and live with you in Germany at this point.

I have no idea if you have any right petitioning for a foreign national given that you have no German citizenship. I would try and find some advice at the military base who may have seen those cases before. Are you stationed in Rammstein or Landstuhl? They certainly must have some legal services availabe.

hello, i read throuh your story and wanted to know ... what did you do ? because me and my fiance are in the same situation right now ... we already filed for K1 visa , but he is in germany still .. he is planning to take vacation so we can go to states to marry , but after that idk what to do ... he said that after I'll be on his orders (SOFA) i can enter Germany ... But i will not even have a green card yet and as I have kazakhstan citizenship , i need shengen visa to enter Germany ... Please help.

If you use the K-1 to marry in the US, but then not stay, you are going to have to file for a spousal visa when you want to return to the US to live.

Going to go ahead and move this topic to the Military forum to see if you get more answers there.

The U.S. base/stationed can be used as it's considered stateside, though obviously it's not. It is more complicated as you have to follow the country visa rules also for her. I know the K1 part as far as the 90 thing is not a problem using overseas duty locations.
