Sooo soooo sorrryyyy for this happening to you!!!!!!!!!!! This is horrible news! CEAC is showing Administrative Processing and not refused. There is hope. Maybe they decided to review it a bit more and there is hope. I spoke to people who received refusal letter and immediately "refused" showed on the website! I really hope for your miracle.

I don't agree with what that lawyer told you about withdrawing and refling. Granted, I'm only a lay person going off what I observe and simple logic. From the way I see it, you go to all the trouble of refling with USCIS and going through the motions to another interview, the only trouble is, the previous denial is still on record and sometimes refling with extra evidence doesn't help so you still end up where you're at.

While it will probably take some time (and I will not counsel patience), approved petitions for an immigrant visa don't carry an expiration date. Once USCIS receives it back, they will have to take action (revoke outright or issue NOIR). In either case, you will see reasons and be able to rebut those reasons.

Just my own two cents, not intended as nor should be construed as legal advice.

I agree with you, when the lawyer said that to me I had a bad feeling and even if she has a great track record there is money involved so I will wait for my nephew who works for one of the top five law firms in the USA to see what he had been advised. I'll let you know and I want to thank you from the bottom of my heart for posting your thoughts. You make perfect sense and I'll post here what my nephew has to say about this.

Do you know if it's possible to send more evidence when it gets to USCIS or NVC? I'm going to have to call and see what number I'm supposed to use the Case number they gave me at USCIS or NVC's number?

Hello my angel, if this were to happen it would be a direct miracle from God no joke and I'm afraid to feel positive about this. Nothing and I mean nothing has gone well for us through this whole thing. It's been pure torture since day one, but God in heaven bless you for your sweet and generous heart. :)

I'm so paranoid, my thoughts were they want me to think there is good news then they will let the ax fall on my neck and off comes my head - again!

Ok. So, I propose us to make our own youtube channel and promote it. We can make videos and discuss our problems. For those who maybe don't want to do a video of themselves, they can do just words on the screen telling their story.

We need a name for the channel. "America give me my spouse" or "Justice for all but the Legal"

I think America Give me my Spouse is better than the other, because I am very much against pitting myself against undocumented migrants as the 'better' person.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

Not to be "pitting" ourselves against anyone, but just saying what about us. The debates are always about illegal and undocumented immigrants but no concern about the rest of us who are also suffering. Sorry if you took that the wrong way.

If you receive an NOIR, the rebuttal will be your opportunity to present evidence to that rebuts the reasons the NOIR is being sent.

Between now and the time you hear from USCIS, there will not be any opportunity to submit evidence.

Also, Solenta, So Sorry that your casse is in AP. I do not write much into the forum, but I know you have applied close to the time and I have read your posts. I know that you feel very sad and mad at this point and there is nothing that will help that, no matter what anyone says or does. But still, please fight for your case, it is not fair that they have us wait for so long but you know that your case is not a fraud and you have nothing to fear, so even if they make assumptions, fight your way out of it. Put your emotions aside and think about every little thing that you can send in as evidence. I know I did! I sent in some of the stupidest things, icluding a copy of a love letter my husband had sent me. haha. Good luck, and hope you feel better!

I told my husband about this and he reminded me he installed windows not sure which one. I started to cry and he said he will find a way but I think he said it just to make me stop crying. :( Thank you just the same your wonderful.
