As I understand it 2 options, above or file a MTR, Not sure what basis you have for a MTR.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

If you have to refile, regarding your bills, there is a way to add c/o for your wife. I will try to send a pm to one of the members. It seems me that he wrote about it (lol).

Thank you for replying.

Sent I-751 packet in on May 9, 2014; her 2 year green card expired May 18. August 29, they sent RFE. I was supposed to reply by November 21.

I did send in:

* a bank statement with both our name on it

* screen shots of our bank account webpages showing mutual access to bank accounts

* screen shot of the Hennepin county website showing shared ownership of our home

* documentation showing my wife as beneficiary on my work benefits: 401K, life insurance policy, etc.

* itineraries and plane tix for our vacation in Mexico, October 2013

I know I sent other stuff. I didn't make a second application packet and a hard drive crash took care of the electronic copies. Argh.

I have my wife authorized on phone, gas and electric bills, but all the bills the send only have my name on them.

How about joint taxes

Better than a web site screen shot, the actual title documents

Better than bank account webpages, actual statemetns covering 2 years

Health care documentation

Car(s) title/insurance

DOn't get hung up on utility bills, those are not as important

simple phone call puts her on the utility bills, it isn't impossible. I added my husband to my utilities even before he had a SS card.

You'll have to start all over - I-130 and I-485 as LPR status is abandoned through the GC she had before.

^^ This.

It's certain to get her status, you betcha.

OP - would you get any help during an infopass appointment at yer local office? [see https://infopass.uscis.gov ]

talk with the shift supervisor, not the person at the first window that calls you in.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

These simple phone calls don't always result in anything that actually shows up on a bill. I am on all of our accounts but can't get them to generate something that actually shows both of our names. Very frustrating!

I didn't bother with utility bills, but did supply mobile phone bills that do show her number and my number (and of course you can show since when the phones where setup

all varies by location and utility service company,

nothing is universal in the USA.

Sorry you had problems in yer locale.

Unclear what you will gain by an infopass, you know the situation.

I-130, is that for someone who is already in the country? Can I file both simultaneously? Will my wife have to leave the country?

check out guide2 in the GUIDES section here - as her basis for adjusting now hinges on her marriage and her presence in the USA:

http://www.visajourney.com/content/i130guide2

her overstay will be automagically forgiven as she's married to a USCitizen,

and

I'm pretty certain she'll receive a 10 year card.

Go Get Em, and Good Luck !

So a few questions:

1) She is working, and by dint of very hard work and taking care of the right people, is getting a pretty decent salary for someone whose parents couldn't afford better higher education for her than a 3rd rate diploma mill. What happens with the job?

2) Does she need to leave the country?

3) Do I file I-130 and I-485 at the same time, or file the 1-485 after the I-130 passes?

1. depends on next round of e-verify. since she's out of status at the moment, it all depends on what occurs when a human checks e-verify.

2. no

3. concurrently. to have more fun, file the free I-131 and I-765 forms as well. [please look these up and understand why I am telling you to file them]

Which human would have to check e-verify? At her job, or someone at DHS? As far as I can tell, she is a very much valued employee, anyone who did such a check would incur the wrath of management.

I did file I-131 and I-175 before. In fact those I still have on my computer from the original app, I will be able to just copy and make make a few updates. :)
