I did, actually, file a service request. So now that you mention it - I am wondering if the person was talking about service request as opposed to the actual petition. Whatever the case may be, it seems like those "level 2" officers don't have much more information than first level phone drones.

Did you read the link that I posted yesterday (the one wooderz originally shared on the October thread)? If Tier 2 doesn't help, you can ask to speak to a Tier 2 Supervisor. You will probably need to found on the section of the Policy Book from which you are basing your request, but you have every right to do so and they have posted this as information available to the public.

If you log into your USCIS account, you should have a reference for your service request and what you posted, and I quoted in my earlier post, is exactly what was displayed beneath our service request, which is why I thought that was what you were referring to.

Oops, see it under the account. Yes, exactly the verbiage. I think they did refer to the inquiry then.

At this point I can't really imagine September petitions not being assigned to an adjudicator. In a perfect world TSC would now suspend approving petitions from October/November to clear out the September.

Wondering what makes some petitions "better" than other. What I mean is why some of us were blatantly omitted.

Too many questions no one can really answer. It's heartbreaking, no matter how happy I am for people who are, what I consider, lucky enough to be already through with it.

Wbeem, does tier 2 call you back? We have no idea now. I asked my fiance to call to uscis and ask to talk to tier 2, but he only talked to the 1st level ( or operator) took our request, that's it. And my fiance was told that someone would get bach to us within a month.

Does tier 2 do the same? Or?

To speak with Tier 2 you have to explicitly ask for it. It's sort of like "open sesame". There is no point in arguing with "level 1" phone operators. They are just following the script. Their job is to give you the same information that's on the web site and get you off the phone.

You simply stay polite, refuse to get off the phone and repeat magic words "I would like to speak to level 2 officer, please" :) You can add logical explanation as to why you want to do that, or just keep repeating. It doesn't matter. You have to say the magic phrase 3 times (I gather their script tells them to actively refuse once, ignore once and finally agree).

Once they say "I will put you through to level 2", they will forward your call to another line. Depending on how busy that line is (usually - quite busy), you may be put on hold and someone will pick up. More often, though, it will put you through to an automatic system that will schedule a callback. If you call from a phone with available caller ID, they will offer to call back that same number. They will state the expected call back time (which I found to be about right, may be a little longer). It will vary anywhere between 15 minutes and 1 hour.

Then your phone will ring, you will be put through on hold (because the automatic callback places you back in the holding line) and in a few minutes someone will finally talk to you :) Don't expect them to be any more useful, but I do find that actual USCIS officers are more polite than first level "get off the phone" types.

Hang on - how can they do that? You are working in Germany right? We have strong labor laws - fight back! This is not a reason for firing someone! Or are you on an extremely limited term contract that wasn't extended?

I agree with Tabeak. I'm in the UK. We also have the EU Employment laws. They may have told you that you are fired, but they can't dismiss you without grounds and without notice.

I'm sorry about the undue stress it is putting on you. I've frustrated my employers no end with the absence of any timeframe over the past 10 months. Do you have terms of employment from the company? This would be a good time to read over your rights and responsibilities.

No it was one of those totally normal contracts where when you quit you still have 4 weeks to work. It was a 1 and a half year contact, so I had 26 holiday days left over and the 20th is my last day to work. I talked to my oma, and she said she's going to help me.. But I really don't want to go back to work at a place that fired me.

Make sure you know you understand your terms of employment. You may be entitled to pay for the unused leave. It might be worth considering getting a bit of advice from an someone who deals with employment law on this. So they gave you four weeks notice of your termination? Did they put it in writing? If not, ask for it.

Right with you, if I didn't had work I would seriously lose it!
I told my work back in February because I thought we were going to get our approval in March.. rookie mistake.

I originally thought I´d give my notice when we got approval from USCIS, but since noone knows how long it takes after I decided I need to keep working until I have my visa - summertime is mostly vacation time anyways. I have no desire to go back to the state of mind I was in before I got my job. - So I am totally feeling with all those of you who are having issues with work on top of everything else.

My job knew, as soon as I got engaged in July, that I'd be going through the process. I wasn't going to lie to them. I figured if I was honest, and assured them that they'd receive plenty of notice, things would be okay. So, I am assuming that my boss just wants to follow up. And hey, rightfully so.

Unfortunately work creates more frustration and insanity for me. It's a toxic environment, so I am looking forward to putting in my notice. Most people in my position would probably just up and quit, but I'm not wired that way. I guess that is both good and bad. haha. Blah.

I'm glad you and Mewbear have a good working environment to keep you going.

You are an honest soul :-) I´d have liked to be able to do the same, but they´d never have hired me in the first place. Gee, I wonder why? lol but all that info is protected by all kinds of privacy laws, so I didnt even have to avoid the question - they are simply not allowed to ask.

I am so sorry to hear this - but TabeaK is right - even though you might not want to go back to work to a place that fired you, you might be able to get more from them than they are willing to offer and it is def worth firghting for that. Do I understand it right that you are on contract for another month or so and get payed for that, but only have to work for another week because the other time is vacation? Basically so they dont have to pay out your vacation to you?
