Cancel K1 or not

My fiancee wants to cancel the K1 and do a student visa because it is faster and then marry when he gets here. If we do that will it be a red flag that he was the benificary of the K1 application? I do not want to do this. I think that we should complete the K1.

You can not enter the USA with a non-immigrant visa (such as an F1 student visa) with the intention to get married and file for your green card. That would be fraud.

If you already know this person and have intentions of marrying him/her. Then you need to stay with a K1 visa.

They have the record of the K-1 so he'd have to prove REALLY strong ties to his home country to be granted an F-1. Odds are slim.

That is a clear case of visa fraud and your fiance can be banned for life from the US. Something to think about.

I suggest getting both visas, student and k-1, then your fiance can fly home for the interview and then return here and not worry, but don't get married before the k-1 is approved.

Or get married there and do student visa and cr-1 visa?

Like everyone else said its a bad idea.

Lots of red flags and fraud.

Stick with the k-1, we all wanted/want to be with our loved ones quick but the k1 is the right way to go if you've already started.

It'll go quicker than you know, once it's done you'll wonder why you were so worried.

There are literally zero chances you will get F1 now that K1 is filed and they KNOW of your fiance's intentions to move to the US.

Just finish the K1 process.

If K1 has been filed, he won't be able to get F1 now. He can get into a big trouble even trying to do that. So that's a pretty bad advise.

do you not understand what fraud and lifetime ban means? Several people answered you already, asking again in a different way still won't make it legal.
