Hi, My name is Samantha,

im having a nightmare with my k1 visa and i need some strong advise, help and guidence.

I have had my medical in london, i have done my DS-160 online, and got all the documentation needed.

I have sent off for the readiness of interview also.

The whole process has been from december for us and now were almost in august and still i havent heard anything regarding my interview.

We have a wedding booked and paid for on October 17th 2014 which is 2 months away.

how can i get my interview before this date and any advise on what to do???

You're never to make plans and arrangements before you have your visa in hand. You'll just have to wait and see when you're booked for an appointment.

When did you send all this off? When London have received your DS160, your notification of readiness form AND the results of your medical they will schedule your interview. You should normally receive an interview date about 4-6 weeks after all of that has been received.

You really shouldn't have booked anything until you received your visa, unfortunately immigration works to its own timelines, not yours!

i have had a us lawyer who has done all the process for us and he said we could book a wedding, i can still change the date if nessasary but i dont really want too.

When did you send all this off? When London have received your DS160, your notification of readiness form AND the results of your medical they will schedule your interview. You should normally receive an interview date about 4-6 weeks after all of that has been received.

You really shouldn't have booked anything until you received your visa, unfortunately immigration works to its own timelines, not yours!

yes i know and agree with you, but we did have a lawyer who said it was ok to do that,

hopefully im hoping i recieve my interview date soon, how long after recieving the date letter, is the actual interview?

I filed a I-130 I-R1 and it's been over a year I have heard that the K1 doesn't take so long, don't understand why it's not fair but lately they are pretty close to the CR-1/I-R1 I think you better unbook the wedding so you don't lose to much of your money. I'm sorry but you should have never done this with such an unreliable and messed up system like immigration. You just can't make plans sad to say. :((F)(L)(F) Good luck to you.

Well, God bless you for believing your lawyer, they have no clue. My nephew is a lawyer and said they can't predict when you will get an interview because USCIS/NVC and the Embassies do things let's say in a discombobulated way. They don't make any sense and they aren't fair.

Hi Samantha!

Hmm. Well, as others have pointed out, you should never do anything that depends on the immigrations process timeline, such as booking flights, arranging for weddings, canceling your apartment lease, or quitting a job. Most related paperwork actually states this, over and over, so I cannot understand why your lawyer said '.. it was OK to do so.'

Basically, the timeline for a K-1 visa varies a lot, depending on many factors, so you could have had your visa in anywhere between 2 and 14 months. Two would have gotten you in trouble because your visa would have run out by the time your wedding is planned, and 14, well, no need to explain that ;-)

Now... you're mostly done with the visa, as you "only" have the interview in London left to do, which, fortunately, is a very easy one compared to others. It doesnt say when you sent out your Readyness form, but it usually takes them about 4 to 6 weeks to plan an interview. This would make it happen in early September. It takes about a week afterwards for them to actually send you the passport with visa, but, in most cases, the moment they tell you "Allright m'am, you're approved!" you know you can book your flights, let all involved know that the date indeed is set, and so on. Then, pack up your stuff, fly out there, relax for a few days (I mean it... spend just a few days together!) and then full steam ahead to the wedding day!

Your wedding date *should* be doable, but, yes, it's cutting it close-ish. If you can move it back by, oh, 2 to 3 weeks or so, without penalties, I think I would *if* I had not heard anything from "London" by the end of this week.....

Congrats, settle down, take a deep breath.... you're almost there!

If your lawyer told you to do this, I'd try to wring any fees for changing the wedding out of his hide, because all the documentation on the forms that have to be filled out specifically tell you not to quit your job, book plane tickets, or do anything permanent about a date without the VISA in hand.

Setting a firm (wedding) date against something (visa processing) that we don't

have a clear control...is obviously going to stress you out. But I also realize

some folks need to have a nice wedding with sufficient planning time, and

that can also be a stress to do that in just 90 days window.

Well, you can't change what's been done, but at least you can figure out

what flexibility you have in moving your wedding date and how much notice they need ahead of time,

and all others penalty costs (if any) and date change conditions they will impose on you.

That way at least you know your options clearly now, and if possible,

you can hold on to the wedding date out as long as you can without incurring big penalty

to reset the wedding date.

No I went for my medical Thursday, but they found I had a heart murmur so I've had an ECG and I just sent the documentation to London medical , that's where I'm at?

Can you work out a time frame for me?
