Hi everyone! I'm quite new here and don't really have much experience with visas and such.. A short back story, I lived in the US for 11 years (middle school, high school, and college) while having F-1 visa. I just graduated an undergraduate program in Wisconsin, but my visa doesn't expire until I believe 2018 because I renewed it very recently. However, my I-20 form expires on August 15th (I had to take a summer class but the class ends on June 15th). So this gives me time from August 15th (to additional 30 days?) until I have to go home correct?

I have been dating my US citizen boyfriend for over 3 years now and we are trying to get married. He and I are both illegible to apply for marriage visa but I wasn't sure if I will have to go back to Korea or not? I know it takes awhile to get everything turned in and processed.. So does this mean that once I turn in the documents, I have to leave the country after August 15th? I know this sounds really complicated but I am SUPER confused even though I checked http://www.visajourney.com/content/i130guide2 many times...

My boyfriend (soon to be husband) and I want to know exactly whether or not I have to go back while the cr-1 visa is taking in place... Also should I consider K-1 visa instead?!?! AHH!

Since you are already in the USA on a valid visa, you do not need a new visa. Follow the I-485 instructions to file both the I-485 and I-130 concurrently, to "adjust status" to permanent resident. CR1 is both a resident status and an immigrant visa category. You don't need the visa, just the adjustment of status.

You do no need to leave the USA. When your status adjustment is complete, USCIS will simply forgive any overstay. For this to work as I've described it, you must NOT leave the USA until the process completes about 90 to 120 days after filing.

Expect your topic to be moved to the appropriate adjustment of status forum instead of this visa forum.

And don't forget the I-765 so you can get your EAD and work. I don't know enough to suggest

Applying for the I-131 (advance parole), as my visa and situation are quite different.

All this hinges on you getting Married first. Keep all documentation of your relationship being real - you will need it.

Hi so I had F-1 Visa for 12 years in the US, now getting married to my fiance of 3 years (US citizen). I know I need to get my marriage license then get married, then file in I-485 and I-130 to become permanent resident.

I also was informed that I need to stay in the US while my status adjustment is complete. Once it's complete is it okay for me to work? I just want to know when I am allowed to finally work in the US... Because 90-120 days wait after filing is a long time without work :/

With the main concurrent I-130/I-485 application, you can apply for two stopgap measures: travel permission and work permission (I-131 Advance Parole and I-765 Employment Document). You will need to wait in the US until the Advance Parole is approved. Both measures take about 70- 90 days to be approved. Check out the guide section up top. Good luck.
