ok i dont want to lose time waiting to be with my wife, am I doing anything wrong now like am I losing time and doing something which will make me wait for nothing ? if yes what shall I do NOW since both NOA2 for i-130 and i-129F not here yet

You have no choice but to wait for the petitions to be approved. Then, you and the attorney's office will get busy again with the National Visa Center process required to apply for the CR1 visa. There's really nothing you can do except prepare for the interview by gathering relationship evidence and learning about your wife's life, family and job. There are plenty of threads to read all about what that means for both of you, so please don't ask us to spoon feed it just for you, OK.

You are getting consistent answers here telling you your lawyer is wrong about the K3 visa. Believe or not believe, the answers from here are not going to change, so you go ahead and choose what to believe and act accordingly.

You use your own valid reasons that truthfully apply to you, to request expedite of any petition. However, there is never going to be any K3 visa in your future. With more reading here, you would have known that. The K3 visa has been virtually but not technically obsolete since February 1, 2010.

I'm going to say to pshbrk...you're incorrect. My wife has been approved for a K3 quite recently and is now waiting to get an appt at the embassy...in the Philippines. She is NOT eligible for expedited status because she does not live in the affected areas - nor did we even entertain trying. It is true that K3's are rare...especially in the PI. To say that there is "NEVER" going to be a K3 in your future - is not exactly true.

To Azzein: All of us are waiting and none of us want to be separated from our spouse - you're not unique in that. As others have said here, the K3 is rarely granted. You need to read as much as you can - on the following websites: USCIS, NVC and US Embassy in your wife's country...and, of course, here. Expect that you'll be separated for about a year...it sucks...it's reality.

No accident. Within days of receiving NOA1 on the I-130, I sent in the I-129F. Within days of doing that, I received notification that it was sent to Vermont, where the I-130 has been since January...and there it sits, still. Then the I-129F was transferred to Texas. Then approved and sent to NVC in April. Approved and in Manila in May. From what I've seen, in most cases, the I-130 and I-129F get "approved" on the same day or a day apart. Then, the K3 will be administratively cancelled. At this point, the I-130 is still sitting on someone's desk in Vermont, moving slowly, if at all, through the system. When it manages to get approved, it will go to NVC where it will sit for at least a month before receiving a case number. Then, a few more months before it is approved.

I might help if you write to your Congressman/Senator and others, as i did - in behalf of all of us who have encountered extraordinary processing times due to Obama's DACA program. I went on a letter writing campaign and, quite possibly, that helped. No accident.

The fact is, some K3's are being processed and getting all the way to the Embassy...well before the I-130 leaves the USCIS processing center. It seems that there are very few people petitioning spouses from the PI with a K3. Most are K1 with the balance being IR/CR... most likely due to what has been happening at USCIS for the past two years - at the behest of Obama.

Believe me, we know that we're not out of the woods yet...

If you cannot point to an on purpose reason for this anomaly, it's "accidental". The petitions should have been joined and stayed together. Why they weren't is unknown. That you can't explain the accident does not mean the result was purposeful or there is any reason for anybody else to think their chances of having the same thing happen to them is any more likely that lightning striking the same spot twice.

My posts mentioned the possibility of some rare unexplained, but not to be expected, result. I'm only 99.9999999% sure there's no K3 in the OP's future. That's good enough for me. If it's not good enough for you, OK then.

I think someone ran the numbers here a while back, and something like only 0.3% of K-3 applicants actually receive one.

Hi, I read a lot here its saying K3 is obsolete and on USCIS website its saying that i have to use the K-3 thats why i am lost between both, and my wife is in USA i am not in USA.

The immigration process caused me PTSD.

when or at which level you wrote for your Senator ? after how many months passed ?

anyway peeps we are gonna wait and see what will happen with me, whatever is gonna happen am gonna write here, i just want to be with my wife, like everyone else wants to be with his spouse, one of the reasons i wanted to expedite this which was my main question is the security reasons where i live, my wife and I already survived 2 car bombings and one of them was when we were walking out of the court after getting married and going home a blast happened in the street which forced us to cancel the weddings and she traveled back to USA next day morning, and before this another blast happened in the street where our hotel was and what made me worry that the American embassy called the Americans in my country to leave as soon as they can and i don't want that the embassy or consulate will close due to terror attacks and then i will have to place to process my papers till they are open again, thats why i wanted to expedite it....

The immigration process caused me PTSD.

First, no, you are misreading whatever you think tells you that you "have to" use the K3. Second, USCIS doesn't issue visas. Really, they don't.
