on July Im going to visit some relatives of my wife.

If I send the I130 of my wife she can still go with me with the turist visa on July. there will be no problem?

If I send the I130 from here, how do I make that payment? 420$

Do they already have tourist visas?

I'd file the I130 now and get the ball rolling, one for your wife and one for each child, plus all the associated fees

only my wife has tourist visa, she got it before she even know me..

OK so the first step will be the I 130, now my question is, If I have to send the I 130 to the chicago office, how do I pay the fees? cash? do I send it by DHL ?

Ok.

So, I have to travel alone first? and fill the I 130 in the US?

or they can enter in the US with a turist visa, and stay in the US while I fill all the forms and start appying for the US residence ?

What I dont know is, how my kids and wife will leave and enter the US the first time. one is 4 years, and the other is less than 1,

Nothing wrong with the questions but I suggest you make and follow a plan. Aaron has given great advise and info that allows you to begin.

Prep the 130 forms for each person. Determine costs therefore payment plan. Connect payment with forms, forward to correct office of USCIS. Get the cases moving then realize you are on a journey rather than in a race.

During all of that you will be able to pose related questions on V J which will result in case progress and the ability to decide with confidence what you personally will do to enact this plan.

If you are truly lost seek a lawyer as Aaron suggests.

you have to bringto embassy your original documents and the kids documents..and you have to apply for I-130 for your with.

He doesn't meet the residency requirements for CRBA. He has not been in the US enough time to pass on citizenship. they can receive citizenship once they enter the US on immigrant visas and live with the father.

OP stated that he was born in the US but lived all his life outside the US. He does not meet the 5 years residency/physical presence requirements to pass US citizenship on to his children. Since his children are not US citizens, he cannot apply for US passports for them.

OP must apply for immigration visas for his children. This is the only way for them to come to the US and automatically get US citizenship based on the CCA.

The first things you need to consider are 1. do you have somewhere to live in the US 2. do you have a job with sufficient income (that is either in the US or can be ported to the US) or assets to meet the financial support obligation for your family or do you have a RESIDENT US citizen who is willing to act as your co-sponsor 3. have you filed tax returns or is Venezuela subject to a dual taxation law with the US

As mentioned by others, you do not meet the 5 year US residency requirement to be able to pass citizenship to your children automatically, so you need to apply for visas for your wife and your kids.

Filling in the visa paperwork isn't difficult, and VJ has excellent guides for each step of spousal/family visa(s). If you can sort out the 3 issues above and are able to read and complete forms easily in English, then you probably won't need a lawyer. As always .. print out all the forms twice. Fill one of them in. Go back and read the instructions with the form and double check that you have answered the question in the way that USCIS require.

1) Yes I have a place to live in the US. in texas I have a uncle of my wife (he is not american but he is legal) here is the place I will be leaving untill I get so setle down

2) I am applying to be bilingual teacher in texas, how much is the finacial support obligation ? I may find someone to act like a co-sponsor.

3) I have never filed taxes in the US, I really have to ask about this.. (I need info about this)

Tomorow I´ll call the US Embassy, and ask about the I130 paymet.. because here in Venezuela we have exchange control, (this thing is hard to understand) and I do not now how can I pay the for I130

There is no need to call the embassy, why haven't you read the guides and looked the form instructions yet? All that you seek is in the I130 instructions an the I864 instructions (regarding the financials)
