Hi,

We are reaching the interview stage and just found information about needing to file I-485: application to register permanent residence of adjustment of status.

I was under the innocent impression that after we were legally married, and told the US gov, that we were good to go... but I guess not
I also was just informed about a filing fee of $1,070!
Will somebody help explain out all of the steps after we are approved for the interview? I don't want to miss any again...

So you will have your interview at the Consulate, receive approval. After that the Consulate will send you back your passport. Then you will have about 6 months from the date of your medical to enter the USA. After you enter the USA, you will get married within 90 days. After that you will file the following forms with a filing fee of $1070:

1. G-1145 This form is for email and text notifications of the status of your case

2. I-485 Application to get Permanent Residence

3. I-864 Affidivit of Support

4. G-325A Biographical Information Updated

5. I-131 Application for Advanced Parole (in case you need to travel while USCIS is adjudicating your I-485)

6. I-765 Application for Work Authorization (so that you can work while your I-485 is being adjucated)

And....AOS in also just hte beginning.....you have a lot of homework to do.....Read the Guides

What does this mean: (underlined)

If the K-1 Visa holder intends to live and work permanently in the United States they should apply to become a permanent resident after the marriage. Please note, K-1 Visa holder will receive conditional permanent residence status for two years. Conditional permanent residency is granted when the marriage is less than two years old at the time the Adjustment of Status application is processed.

If, on the day USCIS adjudicates your I-485 you have been married for less than two years, you receive a conditional green card valid for two years that you will need to remove conditions from (through filing an I-751 before the conditional green card expires).

If, on the day USCIS adjudicates your I-485 you have been married for two years or more, you receive an unconditional green card valid for ten years from which you do not need to remove conditions.

Adjustment of status(AOS) is applying to become a permanent resident When adjusting from a K-1, you will more than likely have been married less than 2 years when your green card is approved You will receive a conditional green card that is valid for 2 years. Sometime within the 90 days before it expires, you will need to file for removal of conditions(ROC). You enter on K1 and get married... Then file for AOS... Receive green card valid for 2 years... Then file for Removal,of conditions (all green card holders married less than 2 years are considered conditional, this is an anti fraud stipulation to deter scammers from marrying, then taking off the next day with their 10 year green card) .... Once ROC is filed you get the 10 year green card..

Read up in the guides section as it seems you are a bit behind in understanding the process... Also, us the site search button for all the associated costs as it is a very expensive process!

I think everyone just about covered it, but wanted to come on and tell you that while the journey can be tough after K-1, you will get through it, just take a deep breath, follow the guides, check the forums to see how others handled any problems you may experience, and you'll do well. Btw, that fee is a doozy, isn't it? You'll somehow find a way to make AOS and all the other fees happen, too. I went through two layoffs between K-1 and AOS, and hubby is still here, LOL. Good luck. x
