Your Case, Your Interview and The Result

Hello;

I read many different experiences from different people (mostly about their interviews) and i wonder how your case affect the result of ur visa interview. I asked this to different people and everyone has a different idea about it. Some people say when your case is at the consulate they review it and before your actual interview they already have a result in their mind (so your case does the 70 per cent of the job(decision) ). Some other says The case is the main thing but actual interview has more effect on the final decision of your interview result. This is interesting to me and it seems hard to tell how it works actually. Soon I ll have my interview and 10 months ago I apllied for a visitor visa and it was denied. peopledon`t think it would have an effect on my k1 application but sometimes i feel nervous. Do you think they review your old aplications also? The interview is getting closer and I started to worry about silly things but it would be good to know how things work in the process,. I am interested in any idea. thank you

Have you asked others from Turkey or an array of different nationalities. If you asked an array of different nationalities then I would say that you would get a different answer for each nationality as it is different country to country. For example I am from Canada and my interview was a breeze, was asked 4 questions, had petitioner there and they approved us in 5 mins. Although Canada is a low fraud country. Now if you asked someone from a country where there is high fraud, they may say that they were asked questions and then were in AP (Administrative Processing) for 1 year or so before the visa was issued. And also every case is different, so with every person you will get a different answer. Hope this helps. And by the way, the general consensus on this site is that even though you may have been denied a tourist visa, it will not necessarily effect you K-1. Again, hope this helps.

My fiancé was denied entry to the US using his previous visa. He is currently in the US on the K1. They did ask some questions about it (I went to the interview with him) but it got approved. Its easy to worry after hearing of denials but as long as you have everything in order, follow the rules with what they require, and can prove your relationship then you'll be fine. It's hard because it feels like the process never ends but soon enough you'll be together and all the worry and stress you experienced feels silly. :-)

This x10. We worried a lot during our K1 visa process. In the end, the medical was a piece of cake, the interview was a piece of cake, and we got our visa in hand 6 days later. We front loaded our application the best we could, and either it paid off and proved the relationship, or they didn't need that much in the first place. Just pace yourself. You'll be fine!

The consuls most definitely have an impression in mind as to whether they might grant or refuse the visa. At rough consulates, the petitioner's presence on the premises (or just outside the building) can make a big difference. Imagine making eye contact with the consul and handing the petitioner's U.S. passport to him as a first move. That act can establish the legitimacy of the relationship that the consul might have been doubting.

A denied visitor's visa shouldn't have an impact on a K-1, unless the first visa was denied because of fraud.

I think they have an idea, if they have looked over your file before interviewing you. Then I believe they ask questions, typically based on the information contained in your file, and based on your answers plus any other evidence asked from you, they make their final decision. Most likely the decision they have in mind to begin with ends up becoming the final outcome, but not always. The interview is not just a formality for show only. It serves a purpose, which is to try and weed out those committing immigration fraud.

I would imagine it's not easy, in the few minutes of the interview, to determine whether there is a real and genuine relationship or not. I think they have to have something already to go on. The whole thing about being confident and assertive in the interview is all fine and dandy, but what if the interviewee is someone really shy, or with a functioning disability like Asperger's? They surely account for that, no? I still think it must be difficult for them to assess whether there's fraud or not, just by the interview. They have to look at the files for red flags.
