Hello!

I sent my I-130 form on november the 27th. It was sent to Nebraska Service center, of course i figured it would take a while because a lot of applications are sent to Nebraska and besides all the philipines are given priority which is totally fine. But I was just checking the timeline that people fill with their NOA's dates and I cannot understand how its possible that some petitioners are getting NOA2 when they sent the form pretty much in the same date as me. And at the same Nebraska center.

Do they give priority to other countries from North America, rather than any other?

FYI I'm from Chile. It's been more than 60 days without getting any notice or RFE? would a call make any difference?

There is no rhyme or reason to much they do, unfortunately. There are people that have been at NVC or TSC from Jan, Feb. March and April of last year that are still waiting. So that would pose the question again of why are November filers being approved before them. I think there are even some waiting from 2012! I would hope there is some reason, and its not just luck of the draw but if you read the March and April threads it almost seems it is :(

Good luck to you in a fast approval! I'd be really happy if I were you that you filed in November and you've been transferred. :) Oh, and yes it doesn't hurt to call and ask.

I agree with what canadianplum said. Since their approval process is pretty inconsistent and unreliable, there's no telling why they were approved and could've been luck of the draw unless they were expedited or from a country that is under difficult circumstances from an event (natural disaster, excessive rioting and violence, etc.)

But cheer up, at least you were transferred right off the bat! There's a lot of us who haven't been transferred yet from NBC and are waiting for that before we can even be approved.

We are in a similar boat as you. Had the NOA1 November 21 and it was sent directly to the Nebraska Service Center from the Chicago Lockbox (we are living in Argentina). I guess we just have to wait and see what happens... Apparently writing to your congressman does nothing. Perhaps someone could write a petition: https://petitions.whitehouse.gov/

I do not see why getting Justin Beiber kicked out of the US (that petition received over 200,000 signatures) should be more important than our cases.

A lot of those approvals in November were from the Philippines.. and they got the expedite because of that megastorm that demolished half their country. Kinda makes sense.

I had to wait a whole year to get my NOA2. You just have to learn to be patient.

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

One piece of advice, don't let the inconsistent and disorderly process of dealing with petitions get to you or you will be angry and miserable for months. Sadly it seems to be a matter of luck where some people get transferred to a faster or slower centre than others.

You filed in November and already got sent to NSC? Consider yourself lucky. We filed in June and it took us 6 months to get transferred to NSC. -_-

They (USCIS) has been know to "Gerrymander" the approvals... That is, approve some at record speed while leaving older applications to languish, that way their "average processing times" go down... Unmfortunatly it is not fair and is totally random (although there have been MANY Philippine petitions that have been expedited as well) don't let it get to you.... Just do all you can to prepare for your new life... There is much to do to get ready!

I tell you one thing, they sure as hell don't give priority to Canada. And with the timelines I have been seeing of many Canadian applicants I seriously think that they see a Canadian application and put it in a different pile. "we'll deal with those Canadians later..."

I am in a similar boat got my Noa1 on November 27th and seeing people who sent theirs in after get NOA2 faster it isn't fair. But what can we do?
