If she wants her green card to have your last name, then yes.

I applied for her I-130 with her married name, but her passport still has her previous last name.

This is only semantics but an I-130 is not something you applied for, it's a petition form you filed.

So we're preparing everything for sending the AoS and IV package finally. I've spent a better part of i think 2 hours going through common checklist reasons (in a selection of posts from the last 2 years) and summing them up for my husband. Lessons learned:

* Everything has to be filled in in black ink;

* If you do a 1040 - put in total income in the place they ask for income, 1040ez - adjusted gross. No rounding up, as far as I understand;

* If you put in anything about assets, provide documents proving your statement, but don't bother doing this if your annual income is enough for sponsoring;

* Whatever's not applicable - mark N/A or risk checklist if they think you missed it.

Stuff i knew but double-checked:

* If the petitioner is sponsoring a spouse, then the spouse is accounted for as the main immigrant and petitioner puts "0" in "married" box for headcount;

* Don't forget to mark little flags like "Yes, i've reported stuff to the IRS" and "Yes/No" on active military duty.

Uh. Hopefully we finally send stuff off in the next couple of days.

I'm the beneficiary.

Don't have a timeline? Don't know how to get started with it? Do it for the statistics sake: VJ video guide

Want to know what's happening with your case? Here's the USCIS tracking page (get an account and see if the case's been 'touched'!). Don't get your hopes up though, some cases never even appear there despite being successfully processed.

Hello, I have a question, I just filed my taxes for the AOS form. 2011 I was unemployed graduated from College, worked as a self employed, 2012-2013 I made over 35k and 60k respectively, do I need a joint sponsor if one of the years I made below the required poverty level? Thanks.

Counting days from I-130 approval is not terribly useful, considering that TSC waits 2-5 weeks to send a case to the NVC, though CSC and NSC are more consistent. At the current rate, expect a case no. 20-30 business days from the day the NVC receives the file. The way things are going lately, 20 business days is a very optimistic estimate.

07/29/2014 - NOA1

11/19/2014 - Transfer to TSC

12/19/2014 - NOA2

01/15/2014 - NVC Received (TSC held it for 3 weeks...)

02/19/2014 - Case no. and IIN assigned; requested embassy change

02/27/2014 - DS-261 available and submitted

02/28/2014 - AOS available and paid

03/19/2014 - AOS mailed

03/27/2014 - AOS entered into system

03/24/2014 - New case no. assigned

03/25/2014 - IV fee invoiced and paid

03/28/2014 - IV package sent via FedEx

04/26/2014 - case complete

06/01/2014 - passed interview

You have to call.

For NVC, you'll be fine. Your current income is still over the poverty line though, right?
