This is about a K-1 fiancee visa

I had a friend apply for a k1 visa for me. She was just very good friend. But now I find someone I wish to marry. Can they also apply for k1 visa? And if they do, will it cause any problems in getting visa?

so can we apply K-1 with diffrent diffrent persons?

pls help us

Uhm.

OK. It sounds a lot like you were trying to commit visa fraud before, but it doesn't seem like there's a lot of point discussing that.

So...

Can you explain a bit more about the first K1? Your good friend - she submitted a petition for you (I-129f)? What status is that in? Did it get approved? Did you already receive the K1 visa?

You're going to have a problem explaining the first petition, since you were likely planning a marriage of convenience. It may look like you are visa fishing, despite your new relationship. Red flags, abound. Do you have good relationship evidence for your new partner? Lots of photos together? Visits? Chat/call logs? Things that show this relationship is genuine.

What is the time frame between the first and second? Does you second fiancé know the situation with the first one? How far in the first application did you get? Your 1st petitioner will have to cancel the original one. On a personal note, I think your proposed cheating the system is a reason so many have problems... There are real couples waiti g to be together, now that you have a real fiancée, you might have a better understanding of that.

Sorry i was not try to do any problem here.....

only my new partner want we will live together so am just asking can we apply for a k-1 again or not....

my last k-1 file and it was cancel in 2012 jan... so can we apply or not ?

Yes, you can apply. Expect questions about the previous petition.

Can I ask is this a same sex relationship? And was the first one same sex? You use terms likes friends and partner. haven't heard Fiance/Fiancee' used once.

Just wondering. Can you apply? Of course. Its fairly soon and expect alot of scrutiny at your interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My Lover who is in India, started this forum. He is concerned that his english is to bad to write here. We are a gay couple. I am in USA, and I was concerned when he mentioned that a straight friend of his had applied for a k1 visa a few years ago. He says he was unaware that the visa she applied for was a fiance/marriage visa until he went to interview. He went to interview with no paperwork. The visa was denied. This is it in a nutshell. He was only trying to visit USA. I know these kinds of actions, no matter what, do harm to those who are legit. I to was concerned about "visa fishing" when I first met him. And if not for my elderly parents, he would wish I come live with him in India. He is better off than I am. I told him I was very concerned about this and would like some opinions. And I do appreciate ALL replies as all are constructive. Thx

As others have said. Yes, you can of course file. You will most likely be asked about the previous petition and K-1 application and be scrutinized more because of it. Make sure you are prepared to answer questions about the previous filing and denial. Also have plenty of relationship evidence to prove yours is bona fide.

yes, this is what I have tried to explain to him. Applying and getting approved are two different matters. and that it will be him that has to answer all the questions about the first k1. This is a new and unexpected venture for me. But I am glad he found this forum, as it will be nice to have someone to ask questions to. In general we just need guidance in this matter. Thanks for any support...and criticism, because it all helps in understanding the process.

Please forgive my cynicism but really? He got all the way to the interview stage with his previous application without noticing anything about fiance or intent to marry?

If I were you I'd be concerned about how this would look to a complete stranger whos job it is to seperate legitimate cases from fraudulent ones.

To a stranger it would probably appear that he knew all along that his previous application was a fraud but at the time same sex marriage visas weren't an option. Did you know him at the time of this previous application? I think the consular officer would be thinking if the previous application was to be with you all along and now is that possible to do the honest way.

As unjust as those previous rules may have been to discriminate against same sex couple, they were the rules at the time and should have been adhered to, even if not actually respected.

I wish you all the luck but I think you have a struggle ahead of you.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

One of the requirements for the I-129F to be approved, way before the interview, is that both the petitioner and the beneficiary submit signed letters of intent to marry - that really should have tipped him off.

We are currently in relationship for 5 months. I have not known him previously. And I agree it does seem suspicious. We have just started discussing the permanence of our relationship and the options....................................................................it seems I may have not told complete truth.:( I will post again when I understand better.
