so i got my k1 visa and it expires on may2014. i already booked my flight and then my current employer wont allow me to resign and threatens me for a breech of contract. my employment will expire on september 2014. what should i do?

questions,

1. if i allow my visa to expire will it automatically be cancelled?

2 follow up question: can we refile for another k1 or is there any extension for such visa?

3. what could possibly be our options?

1. Yes, you can let your visa goes expired

2. Yes, you can refile another I-129F for K-1 visa but you need a waiver if your fiance filed within 2 years, if I am not mistakenly remember. Also, there is another VJer here said that she could get extended her K-1 visa expiration. You should try search the post.

If you're leaving the country, why care? They can sue you all they want, if you've left the Philippines for the US then it's not going to get them anywhere. Tell them to go pound sand.

Just fly, they arent going to put in jail by leave the job.

Do you really love your fiance?

What is your important goal?

Your job or start your life in usa?

If for you it is most important your job's contract then your marriage wont be good

I dont know how there are a lot of peoples in this forums that stat the process k1, a sterssful proces, and then when they get the visa they are asking if they can do another petition.

First thing you have to keep in mind is that k1 it is for leave from your home country to usa, so inmediatelly you start the process you have to keep in mind to start the arrendement to have everythings ready to leave when the visa is isue

Leave a resignation letter on the day of your flight (or maybe give it to a co worker) and then just go..disappear. Be happy with ur fiance. You can still find other better jobs in the US. Good luck! :)

12.12.2013 - I-130 approved, NOA2 via email (never transferred); shipped to NVC

better yet, just text your resignation in from the airport. It will all be forgotten when you land in the US and your fiance meets you at the airport with flowers...

What kind of employment contract did you sign? Which company is this? Filipino companies have weird ### hiring practices, so it's important to know certain things before you commit to them. If it's an at-will, then tell them to piss off. If there are stipulations in the contract that somehow restrict your ability to leave the company at will, then I'd find a way to cover your ### or find an exit clause. This all depends on how important it is for you to have this company as a positive reference.

First, go se a business or contract lawyer and see what the exit clauses are or loopholes... So at least you know what your are dealing with legally speaking...

what form does this threatening come in,

for this breach of contract ?

If it's just verbal stuff, I say ignore it.

If he's threatening legal action - exactly what was in the contract that you signed?

If I were in yer exact shoes, I'd pack my bags, jump on the plane, and not look back for at least 10 years.

I totally agree with others here, tell them that you have your own life to taking care of, you didn't meant it to break your contract but it happen all of the sudden if they will give a bad reference for job purposes then its time for you to explain yourself when you cross that bridge. goodluck and God Bless.

12/3/ 2013 -transfered to NVC from USCIS

1/17/2014 - still no news from NVC

3/8/2014- NVC Invoice arrived paid the same day:)
