Time lines...any chance of Summer 2014 wedding?

Timeline

So, if we put in a K1 application right after Christmas what are the chances of a summer 2014 wedding? I'm Canadian, so I think that helps.

I really want my daughter to be able to start grade 11 in Colorado so she doesn't miss part of the year and feel even more out of the loop, and behind.

Anyone know if she would be able to start school there before I cross the border with my package for immigrating? Would she need a student visa or something?

It does not help that you are Canadian. You will go through the process and have the same processing times like everyone else. In fact, depending on the embassy you will be going though, I have heard that Montreal is usually pretty backed up, so you might have to wait a couple of weeks/months for an interview appointment.

Also keep in mind that processing times for the NOA2 can vary - if they are at, say, 3 months now, they might be at 6 or 7 months in a couple of months (that's what happened when I applied in 2012, but I am keeping my fingers crossed this won't happen to you!). So I strongly advise not to make any fixed wedding plans until you have the visa in hand.

I doubt your daughter would be able to start school before you cross the border, but I am sure others will chime in on that.

When you say summer... July? August?

K1 processes have sped up lately. Odds are decent, but USCIS slows down and speeds back up again without warning, so I wouldn't put any money on anything.

I assume your daughter is not an American citizen?

Being a Canadian helps the sense that it is not known as a high fraud country. Other that that, the process is the same pretty much. I would not cont on a wedding as soon as that.

My fiance and I are currently going through the Montreal consulate. We filed a K-1 last May, and we're still in the process of trying to schedule an interview. A summer wedding isn't highly likely given how back up they are (it took a month to process packet 3), but one can still hope they'll get their act together

Although the US allows illegal immigrant children to attend public school, I presume you want to do this legally.

A student visa is not appropriate. Foreign students can only attend one year of public high school. They have to pay tution which will be several thousands. Furthermore, an F-1 student must have a foreign home to return to and have no intent to immigrate.

If your daughter crosses the border without a visa and starts attending public school, you can expect to have some immigration problems.

It's possible. But would I take the chance and plan a wedding? Absolutely not. You never know what the processing times will be, and being from Canada doesn't give you a leg up.
