First, I'd like to begin by stating that yes I know it is unlikely that it would be approved under normal circumstances since my wife has every intentions of emigrating. However, my situation may be unique enough that they may say yes. Just trying to see if someone has the same experience as mine.

Here's my situation, I applied for I-130 back in March and still waiting on the awesome NOA2. I just found out about this crazy B-2 visa (I know right?). I cannot go on vacation often enough to see my wife because of my job but with the tourist Visa she can come to me. I used to go every 3-4 months and go to Honduras for two weeks at a time but with my new job it has been since April since I last saw my wife and it is hard but bearable.

Now I know the situation will always say that if my wife visits, why would she go back? My reasoning is this, so that she can get her IRC 1 and get her green card legally that's why. What makes my situation unique?? Wait for it.....

I am active duty in the military that's why. If she comes and stay for maximum of 90 days she may not want to go back but to me she has no choice in the matter because on the 91 day she will be here illegally. Her being illegally living in my house means I am harboring a fugitive (ok, just an illegal). That would bring all kinds of hell on me so I would guaranteed her bags would be packed on the 87th day just in case of a flight delay/cancel. Her being here after the allotted time can kill my career (11 years career), my security clearance and not to mention my first sergeant would have my head on a platter.

I digress, but how about it folks. Anyone in the same situation ever got one approved? Any help would be appreciated.

I have seen lots of cases where Military Personnel have married people here illegally never mind who just overstayed. Seems no biggie so do not worry.

Actually for those here illegally there is a route to adjust, Parole in Place not available to non Military. Well usually.

It's worth a shot, but be prepared and know that it's still a long shot.

Coupled with some evidence of loose ends she might have back in Honduras, it still might be worth a shot.

The only downside to applying is the application fee.

Thank you guys. Yes the one overstaying their expiration date to me is a parasite that kills it for the honest folks. I concur the filing fees of $160 is quite a bit but coupling that with roughly $600-700 I send my wife every month it is really small price if I can get her over here for 3 months. I don't have to send her that much but at the same time, I want her to be comfortable. It is true the dollars can go a long way but in her town Comayagua, if I wanted her to be in a safe neighborhood I have to pay. If I want her to eat well, it costs. All in all, if she is approved, I will be one happy man.

Also I promise to all my fellow VJers, the wife will NOT overstay lol.

Just keep in mind, a rejection for "immigrant intent" has absolutely no bearing on an immigrant visa application. As long as she is honest in all her answers, the worst case scenario is a "no." Well worth a try!

Well, she is going to the consulate in Tegucigalpa tomorrow. I told her that when she gets there to call me and hand the phone to the case officer so I can convince them. My phone etiquette is up to par and I will provide god knows the contact info of my first shirt, C.O., Wing Commander, Supervisor, even my drycleaner lady (her name is Sue btw) to make sure I know the risk of her overstaying her visa lol.

Perhaps it will work, perhaps it won't but if I can share just one New Year's Eve with my wife just once in the three years we've been together all of this waiting for the I-130 approval by the USCIS would be forgotten and the world can be a wonderful place again. Ok a lil melodramatic but you guys get the point.

No phones?????? Ok I need a back up plan then. Hmmmmm I used to know the direct number to the defense attache there. Maybe if I can DSN through them it could work.

No electronics of any sort actually. They're very particular. Scramble the guy's number!
