I am filing a I-130 for my filipina wife this week and can you tell me how long it would take for her to get the visa in hand

I am on almost 4 months but, they are still working on March and April. Yes, USCIS gets 12 coffee breaks a day. What confuses me is F!'s get visa in 5 months but a spouse takes 12+ months. I can't believe they allow that to happen

We filed our I130 last December and our interview is on November 26th it'll be probably over a year from start to getting the visa in hand. But I do have to admit that we were really late in submitting our AOS package to NVC by like 2 1/2 months so our timeline would be a lot shorter. We got I130 approval in 5 months which includes an RFE

We filed our I-130/CR1end of June and I-129F/K3 end of Aug. Until today I knew no more than everyone else on VJ. Today my congressman sent back a response from the USCIS from their inquiry on our case status.

- Both of our petitions have been joined and are still at the NBC

- Both of our petitions will be adjudicated at the same time (clearly now its been confirmed 129f/k3 visas are NOT being processed any faster

- "Due to processing delays at the VPC's unrelated to our case...." our applications will not be adjudicated until May 2014 (which puts us out to just about exactly 11mths)

11mths appears to be the standard ongoing processing time now for most generally everyone with uncomplicated cases.

Bummer....my husband and I will have been married a year and a half before I see him again.........sad :'(

I hope that you are now pushing your congressman to ask why they are holding the K3, which processing time is currently listed at 5 months. It is my understanding that they have been adjudicating them together in the past as both were taking the same amount of time. However, now that I-130s are again taking 1yr plus, the law states that a K3 should be made available. I would ask your congressman to pursue the K3 further as it was designed and put in place for this very scenario. My 5 month mark is on the 13th and I will also be pursuing this once I am outside the 5 month normally processing.

Fiance visas are being processed faster since when the beneficiary arrives in the USA they still need to go through the adjustment of status, work authorizations, etc. CR/IR visas are all processed up front and under much more scrutiny since it's for perminant residence, not simply a visa.
