Hi All.

My wife has a citizenship interview today which she passed but during the interview when the officer was going over with her citizenship application again he asked her if she has ever been married and she said No by mistake. She applied for her citizenship about 4 months ago and we were not married then...we just got married a week back in the courthouse and now today in her interview she said she is not married and she realized her mistake later today.

Gurus, can one please help as to what should be done now? Do they verify everything again? or if she during her oath ceremony tell them that she has been married ....will that help?

Please help.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I don't know the specific answer to your question, but I remember at the oath ceremony, there was a form that had to be completed. One of the questions asked if you had been married since your interview and your oath ceremony date. You just mark yes or no and show it to the officer. There are a couple of other similar questions that you have to answer on the form too. I noticed people filling them out and the officers checking. Some people had marked yes for certain things and were briefly (1 minute or less) asked to explain. It didn't seem to be a problem. In your case, I don't know if they would try to match up dates and see if everything is correct. I suppose you might want to make an Infopass to see if your file needs to be corrected. Honestly, I'm not sure how this will affect you, but I do know that you will be asked to indicate the change in status on your oath letter that you take to the ceremony.

let your wife go for info pass and request to talk to the officer that he is handleing her case, lying would cause her Citizenship to be revoked.

Did he ask if she has ever been married or if she has ever been married before ? ( I suspect the second and then she did give the right answer ) He was probably making sure any previous divorces where documented

This will not be over quickly. You will not enjoy this.

I don't think so, the martial status is very important part that the IO needs to verify during the Naturalization interview. the OP clearly mentioned that his wife was not married At the time of filling, so it makes sense to me that the officer wants to confirm her martial status. Second, since her martial status was changed after the filling she has to inform the officer about that change in order to correct that part. if they have any knowledge about her marital status, she will receive a denial based on not showing a good moral character. if she got approved without fixing this mistake, she might got her Citizenship revoked at the time if she decided to petition her husband if he is not a USC. This is my opinion. that's why In my view the OP wife has to go ASAP to fix that

Her marital status isn't a material misrep, nor is it a moral issue. It IS something that's listed on the certificate though.

I would either:

1. Make an infopass and correct it (taking the marriage cert) or

2. Wait until the Oath.

Personally i would do #1. Explain that because you were recently married it was still reflex to answer no.

Thanks a lot gurus for providing your helpful inputs. I did not know anything about info pass appointment then but in our case we went to the USCIS chicago office and my wife met with the officer who interviewed her and told her that she misunderstood the question and she wanted to correct it. The officer was nice, and he asked her to fill the yellow form and attach the marriage certificate along with it.

He said he will update the record.

So it was easy ,,,,,,,,on the other hand the lawyers were asking 750 to 800 USD/hr to just discuss this case.

Great news! Thanks for sharing and I hope you and your wife can sleep easy now :-)

Question: did you have any issues when you asked to speak with the IO who did the interview? I'm going to my USCIS office, where I interviewed recently, for an infopass next week. I doubt they'll let me speak with my IO, so I'm just hoping I can leave some documents for her. If anyone has had success requesting to speak with their IO during infopass, could you please share your experience and comments? Thank you!
