Hi Everyone,

My wife came to US via the K1 Fiance Visa process. We got married in 2009. She was granted conditional permanant resident in 25 April 2011. She received her green card for 2 years after that. We then filed for the removal of the the conditional permanant resident in Feb 2013. She received her 10 year green card early July 2013.

I understand that she has to be a permanent resident (green card holder) for at least 3 years before she can apply for US Citizenship. My question, 3 years from her conditional resident (April 2011) or 3 years from her removal of the conditional resident (July 2013)?

Thanks in advance.

Steve

Three years from when she first became an LPR, conditional or not. It should state on her card LPR since. You can file 90 days prior to the three year mark and not one day sooner.

3 years from the resident since on the green card she got the first time not marriage. so if she got it on 25 April 2011, she can file on January 25, 2014. Good luck.

Oh crapola!!! My wife's date is 12/29/2010 so she can apply 10/1/2013. I was thinking it was three years which would have giving us three more months. Well, there goes our nice, relaxing weekend....oh, well. If this goes as smoothly as the last process it should not be so bad since she is so detailed and organized. oops8rh.gif

May love and laughter light your days,
and warm your heart and home.
May good and faithful friends be yours,
wherever you may roam.
May peace and plenty bless your world
with joy that long endures.
May all life's passing seasons
bring the best to you and yours!

She doesn't have to file 3 months before, she can file any time after that. Or not at all.

I am well aware of that, but why wait? May as well go ahead and complete this last leg of government paperwork. Sooner we get it rolling the sooner we cross the finish line.

Some people wait to save the money (both for filing and passport etc afterwards). To travel without needing the US passport. Because they're not sure they WANT to be a USC. Because their home country doesn't accept dual/multi nationalities.

It's a personal decision.

All English Muffin was saying was that your apparent "panic" that your date is coming up sooner than you thought, needn't be a panic because, unlike ROC, there is no deadline to file. So file when you wish.
