hello everybody

I have a big problem and I with someone help my

this is my situation;

I came to USA with visa k1 since September, 2 weeks later I married with my husband ( U.S citizen), in November he sent I-485 to the USCIS for my adjustment of status

me and my husband we have been married for almost a year, our problem has been happening for a coupe of month and we can.t solve difference.

so we deiced to divorce because I know just a few week that he sent a letter to the USCIS a letter that he want to withdrawal my form I-485 and all other associated forms ( he sent the letter one month ago)

now I want to divorce with hime and want to know my right if I divorced because I don`t know someone how can help my I don`t have family here plzz I needdd help

You have been married a short time. Best to just let it be an uncontested divorce and go home. Ask for the money for travel, plane ticket, bus, food, and of course all your personal items. If you have purchased anything jointly try to get some agreement on that. Beyond those small things not really a lot to divide. You are probably not entitled to any support so just take what you can get and move on.

You cannot adjust if petitioner withdrew the I-864. Your EAD/AP will be cancelled and you will have 30 days to leave.

Can you have a mutual friend sit him down and ask him

to at least give you a plane ticket and some pocket money?

then you'll be able to pack your things and depart decently

you can divorce him in your own country. I hope he does

help you to go home at least good luck

my husband want me to sign the separation agreement but how about my alimony (spousal support ) and my rights in this country if I sing this paper

You havent' been married long enough to obtain alimony. You have no rights in this country since your AOS will be denied and you wlll have to either leave or live here illegally. Best to just pack your things, ask for a plane ticket and expenses, and go home.

Unfortunately, you have been misinformed about alimony. With current immigration laws, you have no rights if you have not adjusted to conditional GC. He is asking for a legal separation, which is the initial step towards divorce.

I don't know, I wouldn't sign anything without a lawyer. They have Legal-aid everywhere. I do think most are right though, you don't have many rights here legally to stay because you have not been married long enough a separation agreement is not divorce papers though and I wouldn't sign that at all. My question is being that it is VERY hard and a long process to get you here why would he involve your paperwork and why does he want a divorce? I suppose that is personal but seems valid

This sort of divorce should be very simple. Hiring a lawyer seems to be a waste of money - perhaps legal aid to explain the process but a lawyer is going to charge more money than the OP is likely to obtain from her husband in a divorce settlement. All she really needs is a plane ticket home. Absent child custody or issues around significant assets (which is unlikely given the short duration of the marriage) my advice (having used mediation to amicably settle a much more complicated divorce) would be to cut her losses and focus on life back home. I don't see why she would need to remain in the US waiting for the divorce to be finalized (will likely take 6 months minimum from the date of legal separation). Free legal aid can answer any of these questions.
