Hi guys. I have an issue and I need an advice.

I was engaged with someone 2 years ago , we filed a K1 visa and got our NOA2 last August 2011. But we broke up last 2012. Our relationship did not work because he cheated. So , I ended it. I didn't proceed since I got our NOA2 last 2011. I didn't undergo my medical and interview appointment. We just left our application and ignored it. so we thought, it was automatically cancelled. I am now engaged with the most loving and wonderful person and we filed our K1 visa last February , 2013. and still waiting for our NOA2. I read a topic here that one of K1 applicants was denied for "multiple petitioner".. I don't want it to happen on me. I contacted my ex but he didn't reply. I need your help here guys. How can I cancel my old K1 application? Who do I need to contact to? My interview might be soon and I don't want to be denied. I love my fiance so much and I want to be with him soon.

NOA2 has an expiry date of about 4 months. You should be fine.

Beyond that as a beneficiary you cannot cancel a petition.

Hi Nikir, thank you for your response.

I got our case number last 2011 with my ex fiance. I just didn't proceed and I didn't want to marry him anymore. Do you think the embassy will just ignore that previous case?

I don't think that it won't have any effect. There was another topic on this issue - pretty much the same situation and they were told at the interview that the K-1 petition (1st one) has to be withdrawn first - there was no visa issued. Check it out in PI forum, not sure if there were any recent updates.

That was a weird situation where the preceding K1 was at the same time as the secondary K1 visa interview. I believe they overlapped somehow, not with YEARS apart.

However, the only option for the OP is to have the ex-fiancé make sure the petition is pulled and cancelled. Until the beneficiary submits information, this is not a K1 visa, it is merely a I-129F petition and only the petitioner can do anything about it.

I tried to contact my ex fiance and he did not respond to me. We are not communicating for about 2 years now since we broke up. We both thought that our case was automatically cancelled once we did not do anything about it.

They MIGHT ask you questions about your previous relationship given it was only a year ago that you broke up with your previous American fiance (you said 2012, maybe it was a typo) and are "in love" with another American so soon. They also might not, just be prepared.

same situation here...I took my interview at USEM on july 15, 2013 the consul didn't tell me that I am approved though but they didn't give me 221g form...they just said your delivery address blah blah which is my home address then you can go home now...when I check my status on CEAC it says "Your case is open. Please check your status after two business days via the CEAC launch page." . so goodluck!!! just pray everything will be fine..;)

is interesting, there's another case in Manila on AP after interview for this exact same problem.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

we almost have same problm teh only difference is my petitioner is my parents...but still "multiple petitioner"...bcoz we r so worried that time my f called USCIS and asked about if do we need to cancel my previous petition or what we should do?...they said i have nothing to worry....i dotn know if dis will also applicable to ur situation but atleast u will ahve idea..the best thing u can do is tell ur f to call USCIS about this matter(for u to have peace of mind)...ur a feb filer ?wow ur almost der goodluck to all of us...
