Last time when I called, I asked the same question.. What will happen to our old AOS if they get reviewed after 23, and did not get any clear answer. So I am too in the same boat.

Been waiting so long too say this... "CASE COMPLETE!"

I feel there are more chances of us getting RFE than not. I am glad you are doing the same. I was told by one representative last week that i should plan ahead and send it.. Just in case i get an RFE!!

I am thinking to attach a letter with the new affidavit form.

I am not sure why it is taking so long for them to review document they received on 6 or 7th June. If they start reviewing our documents today or tomorrow then I am not sure if new AOS is required but no harm in sending new one. I thought case will move much faster in NVC but no hope... I wanted to get case complete in June.

looks like yours will be approved in a day or two.. Looking at other's timeline.. Mine was delievered on 10th. I feel my chances are really slim for it to reviewed today or tomorrow. I will be mailing it today or tomorrow just to be secrure. I will call NVC and try to talk to supervisor. May be she can give me little insight.

I would suggest NOT sending in anything unless it's requested. It could cause a delay if they receive something when it was not requested. Just be patient for them to review it.

Hey - thanks for filling out yer timeline - when I first responded to you, that thing was blank.

If you want to go the waiver route - ya gotta bring it to the interview (the I-601). There's also the new I-601A, which you could have applied for right after the I-130 was approved.

With the I-601 - it's my understanding you have to apply after the interview. Which adds more time .

With the I-601A - you could have delayed doc intake at NVC until the approval on the waiver came in.

So, 6 more months, you say? at this stage - I'd recommend do nothing, except to wait until you are assigned an interview date. Then, about 10 calendar days after receiving the interview date (ya need that lag for the casefile to be shipped to the IV Unit and opened) email the IV Unit and ask for a later date , to be 6 months + 2 days past the bar end date.

Sure, it'll delay more - but chasing a waiver takes some time, also - and I've not idea how long - people have written of 4 to 10 months - but I honestly don't pay attention to that metric. We've a waiver sub-forum here, you might want to look at that.

(gods - have I confused I-601 with I-212 or I-202 ? eeek)

I say do more research, hit those sub-forums, see whats what.

Thank you Darnell, for you help..., I believed that you can only apply for 601 A when you are inside the country, what is not our case, I'm not sure..., I need to search more at the waivers forum, but I think that we will try to do it, some lawyers are saying that is taking about 60 to 90 days, I think is better that wait 6 more months right?..., I don't know if Rio de Janeiro take waivers, I think that they will ask you to send to Chicago, but just in case, I probably will take with me... thank you good.gif

Saylin - a data point to change (on me)

email 'caught up' at NVC - they added the stuff I sent in for the IV set (more bonafide marriage evidence)

and

a new case complete date of today, 20 June 2013.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
