I have a small question my husband is in Colombia and has never came to the States. I have started filling out the I-130 forms and my question is since my husband is not here to sign the G-325A what can I do? Do I just scan it and email it to him have him sign and email it back to me?? Or do just send it in blank? Also since we have never lived together how can we prove that we have a valid marriage since we don't have anything with both our names on it? Oh and do I send a copy of the marriage certificate with and English translation??

No, he has to sign it, and it has to be the original signature. You can fill it out, scan and email it to him, and then have him sign it, but he has to send it back through snail mail. It would probably just be easier and quicker for him to fill it out himself and mail it to you, but that's up to you. Good luck!

Edit to add: Yes, you have to send an original of the marriage certificate, along with a translation into English. As to evidence - be creative! Phone bills showing you've called him, skype convos, facebook posts, pictures you have together - all of that works.

No, he has to sign it, and it has to be the original signature. You can fill it out, scan and email it to him, and then have him sign it, but he has to send it back through snail mail. It would probably just be easier and quicker for him to fill it out himself and mail it to you, but that's up to you. Good luck!

Thank you so much!! We have started getting all the phone bills together which haven't been very cheap since we started dating..lol....as well as skype messages, and pics just thought we would have to have like bills together and such but if the above works then we're set!! Thanks again so much!!

Not necessarily. You have to be prepared for the USCIS to not send on anything you send them. They do not ask for an original so you do not have to send an original, just a photocopy or a certified copy if you prefer but not the original (or only certified copy you have for example.)

Niki's right. Photocopies are good for USCIS, it's NVC that requires originals. I didn't even realize I put "original" in that first post until I reread it just now. wink.png Sorry for the mix-up, OP! All the other things do apply.

Thanks so much for the responses guys!! One more question on the I-130 form #1 its asking for FAMILY name would that be my maiden name or would that be my married name?

If you have not changed your name to include your husband's last name in your name, then just use your maiden name.

My wife did not change her last name after marriage, so she used her maiden name in every form where USCIS asked for her name, good luck.

Family name is your married name. However as you do not have to change your name you do not have to put it, and can put your maiden name instead. If you do not have any paperwork, and won't have it by the interview, in your "married name" then don't bother using it on any of the forms. Your green card will have whatever your passport says.

Thank you! I have changed my last name and I have changed my SSN, DL, work documents and things. So I'm assuming that I will be putting my husbands last name. Thanks again so much for your response.

Thank you for your response, I will be using my husbands name so I'm taking it that as long as I have my SSN, DL, check stubs, and passport and bank account in his name we will be ok (at least I hope)unsure.png

We are just starting this as well and we figured it would be best for me to fill out the form, sign it and send it via snail mail. You also need passport style photos of the beneficiary, so make sure he sends those together with the form, so you do not have to wait for the letter twice.

Thanks Ivy!! We are just now starting the process too and we're excited and yet scarred too lol....He has already sent me the passport pics and everything else except the 325 A form :(
