hi everyone hope you all are having a good day.

i am now with my fiance here in new york.

my visa expires this 24th of april but me and my fiance is not yet married,but we do have the license.

he is just having a hard time to get an off from work.

so my question is,iwill it be a problem if we get married before my visa expires and file the AOS few months After the marriage?

im pregnant and we've been spending and preparing things for the baby and we think that we wont be able to file the AOS in time since

the fee isnt that cheap.

all your response is greatly appreciated.thank you.

You need to get married in the 90 day window from your US entry and then file for your AOS as soon as you can. The K-1 visa and 90 days are two different issues.

Yes, it is a problem if you dont marry in those first 90 days.

But not an unresolvable one.

If you do not marry within the prescribed 90 days you can still file AoS whenever you want, but you will need to submit an I-130 (together with its $420 fee) on top of the other required documentation.

A K-1 who marries within the 90 days does not need to do this.

When did you get here???? You have 90 days from the time you landed at POE, which is different than date on Visa or date on I-94. Also, you can send in AOS at whatever time, you just know that you will not be able to work etc... However with a baby on the way, that will not discourage you if you are filing late.

My concern is you are married within the 90 day timeframe, otherwise, you have voided your petition, and have to file through a different process.

Just go to a courthouse and get it done ASAP. I would be terrified to get married on that 90th day. How do you know something will not happen that day that prevents you from getting married? I would much rather be safe than sorry! It only takes 10 minutes at a courthouse. Do that and then have a ceremony later when you have more time to plan.

No. As everyone else said, if you marry within the 90 days, you can file for AOS when you are ready. The sooner you file, the better, but waiting a couple months will not be a problem for filing your AOS.
