Hello guys,

I have found a post from someone from Egypt about his N400 interview and when i looked at his timeline, I found this

1/22/2010 Sent I-751 Waiver to VSC

1/26/2010 NOA

2/19/2010 Biometrics

4/30/2010 Card Production ordered (الحمد لله )

5/05/2010 Received Approval Notice

5/22/2010 Card Received

N:400

12/07/2012: Sent N400

12/13/2012: Check Cashed

12/12/2012: NOA

12/26/2012: Biometrics

02/08/2013: Placed in line for interview

02/11/2013: Scheduled for interview

03/18/2013: Interview

He applied for N400 soon as he received his GC, so the question here is :

1- Is it possible for my husband to apply for N400 soon as he receives his permanent green card ?

2- Is there any waiver for that time period or what exactly...Thanks

the 'accrual date'

is the first date on the first green card, +3 years.

So, what's that first date on his first green card?

90 days prior to the accrual date, he's allowed to apply ..

Are you sure you reading this correctly ? He sent N400 more than 2 years after receiving his 10-year GC which means it was more than 4 years from first conditional green card.

You are missunderstanding the timeline. They filed for Removal of Conditions starting 1/22/2010, ie they had a conditional greencard already for some months/ years at that time, no time waiver involved (and it does not exist).

That being said, to your question 1- yes, depending on how long it took to get the ROC approved, it is possible to apply for naturalisation as soon as you get the ten year greencard- or even before.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That "person" seems to have a whole lot in common with me :)

There's a 3-years (-90 days, almost) difference between the permanent greencard and the date I applied for N400, look closely at the dates. And that 10-year GC was a couple of years after I received my first greencard. I'm also applying under the 5-year rule.

In summary:

Resident since 3/8/2008

Conditions Removed: 4/30/2010

Applied for N400 12/2012 (90 days prior to 5th GC anniversary)

The waiver mentioned is for the joint filing requirement.

In your case, your husband is eligible to apply based on the 3-year rule, i.e 3 years ( -90 days) from the date he became a permanent resident (assuming you've been married since or before that date).

You must be a LPR for at least 3 years AND married to the same USC that you received your conditional GC for 3 years to qualify for the 3 year rule. If you are not still married to the smae USC than you must wait until you are a LPR for 5 years. Have a look at the requirements for becoming a USC here and scroll down to page 5 of the document to see if you qualify.

You must be a LPR for at least 3 years AND married to the same USC that you received your conditional GC for 3 years to qualify for the 3 year rule. If you are not still married to the smae USC than you must wait until you are a LPR for 5 years. No. he has to be an LPR for 3 years using the 'married' clock.

So when he comes into the USA and is issued a green card, study the first date there on the green card. That's the date that governs the start of the 3 year duration.

Bit envious of this;

1/22/2010 Sent I-751 Waiver to VSC 5/22/2010 Card Received

Received the ten year card just four months later from the date of sending in the I-751? We send in our I-751 precisely 90 days before the expiration of those conditional cards, didn't receive that ten year card until one week short of 15 months. Was a lot of extra chasing around back then to get that I-551 stamp in a foreign passport. But just one week before my wife's N-400 interview. Where shortly after that, they took that ten year card back again.

This timeline does not go back to the AOS stage, but would have to be another 21 months before that 1/22/2010 date when that conditional green card was issued. Or around 4/22/2008. Should be eligible to apply now for the five year. And save sending in another ton of evidence that the USCIS already has.

I presume my wife can apply for US Citizenship on May 3, 2013?

She got her GC on 2/12/13

Resident Since 8/03/10

How can she be a resident since 2010 but only have a greencard since 2013? Do you mean she got her conditional greencard 8/3/10 and her ten year greencard 2/12/13? If so, she can apply on May 5th- NOT 3rd, you;d be rejected. The 5th is 90 days from the three year anniversary of 8/3/10/
