Proper way to delay the NVC process

Hi all,

In one of our previous posts, we were mentioning how I need to obtain my visa for October. Following people's advice we filed the I-130 and as expected it was approved really fast since the USC lives in France with me.

We now received the bill from NVC asking for $88 for the AOS. However, we would like the visa to be issued ideally around the end of August or beginning of September; then the question is "what's the proper way to delay the NVC process? Do we wait to pay the $88? Do we pay the $88 and then take our time to send the I864, DS-3032 and DS-230? Or do we complete the NVC process and delay the process at the embassy (medical appointment or interview)?"

09/2008: Met in France
12/2009: Wedding in France
Since then: Living and working together in France

USCIS:
01/15/2013: Got our official NOA1
02/08/2013: Got an email stating our I-130 was approved followed by the snail mail NOA2

NVC:
03/2013: Received the AOS and IV bill ==> Paid all bills and decided to wait before filing the AOS and civil documents for personnal reasons.

10-11/2013: AOS & Civil documents were sent to NVC

12/19/2013: RFE on AOS

01/12/2014: New AOS was sent

02/10/2014: Received appointment letter

Embassy:

03/12/2014: Interview: approved

03/14/2014: CEAC website went from Ready to AP to Issued!

03/18/2014: Visa in hand!

your control is at NVC stage. You have one year with them to submit required documents . So I would suggest make your payments ( you never know when they will have another fee inccrease) but delay your submission of I-864 and DS 230 documents until around June ending. They will complete complete your case in July( if no Checklist is sent) and schedule your interview august /sept

12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

you can do it the right way, or the wrong way, like we have...

applied sept 2010....just had medical last week...

you have more control than you think.

2004 - we met online.

7th May 2007 - filed I-129 paperwork

9th June 2007 - received I-797 notice of action

13th November 2007 - I-129 approved

18th December 2007 Visa and medical interview

12th January 2008- Shipping company arrived

14th January 2008 - landed at Newark Airport.

9th March 2008 - got married(received SSI number)

April 2008 - My things arrived in USA from the UK

9th March 2009 - our 1st Anniversary

14th June 2009 - returned to the UK

9th March 2010 - our 2nd Anniversary - spent apart - so lonely :(

1st September 2010 - filed I-130 (applying for IR1)

11th Sept - Received I-797c address part C error

13th Sept - Resubmitted I-130

24th Sept 2010 received second I-797 NOA status - "initial review"

4th January 2011 - I-130 Approved - moving to NVC!

12th January 2011 - I-130 forwarded to NVC.

31st January 2011 - Notification of LDN number received in the post.

Remember, once issued, a visa is typically valid for 6 months. So, even if you went through this process at a "normal" pace, you'd probably have a case complete by the end of March, with an interview sometime in May, I'm guessing, which would give you until around November to immigrate.

Remember, once issued, a visa is typically valid for 6 months. So, even if you went through this process at a "normal" pace, you'd probably have a case complete by the end of March, with an interview sometime in May, I'm guessing, which would give you until around November to immigrate.

Yes and it's mostly complicated, I have a work contract tying me to France until Sept 31st, but for diverse reasons, I might have to stay longer (up to the end of the year) for reasons including work contract extension, baby and other things. Therefore, there is no reason for me to have my visa issued too early and it's better to keep my options open.

Ah, completely valid reasons! good.gif I was just wondering since you had mentioned October in the initial post and was a little confused!

Your best bet to delay things then, would be to take half a month for each step. So, wait until April to pay the AOS fee. Wait until mid-April to send the DS-3032. Wait until May to pay the IV fee. Wait until mid-May to send the AOS package (respond to checklists right away though, if there are any). And then wait until June to send the IV package (again, reply to checklists if they come). Your case would then complete around mid-June. And, the typical global average between case complete date and interview is 2 months. So, with a case complete in mid-June would give you an interview around August sometime. You can always change the above time frames a bit for each step, to make it longer if you wish.

Keep in mind, if the interview date is not satisfactory, you can always contact the embassy and request for a later date.

Just wondering if you can elaborate how you managed to delay by like almost 3 years...

seems like officially, you can only take up to 1 year to submit your documents at NVC and now that AOS and IV packages are to be

submitted together (1 submission point instead of two previously), there's no more chance to delay at NVC once the packages are submitted.

You can take 1 year to send the ds-261, 1 year later pay and send the AOS, 1 year later pay and send IV etc... it's pretty easy to delay.
