We are going to get his divorce papers. His whole family lives here. Mother father brothers & sisters. I don't understand why they denied him the first time he filled. The only thing overseas is his ex wife and his kids. His brothers are trying to help too.

I'm just very confused with this whole ordeal.

He is here on a tourist visa. His visa exp june 11, 2012. So he is only past his 180 days since dec 11 of this year. He is already divorced from jordon. His lawyer wont send him his divorce papers because he still owes him $1000. I'm trying to figure out a way that he can go see his kids and still come back. He applied to stay here in the u.s. but he was denied. He is tired of waiting on everything but is torn between me and his kids. I told him to go and see them. They need him more than me. But he doesn't want to leave me here and be penalized for his visa expiring.

If I go to jordon and marry him there. Can I come back to the u.s. and file a spouse visa since we will be married then?

Or any other suggestions. I'm trying to get him to wait till everything is fixed. But he misses his kids so bad. He cries everyday. I want to help him.

how did he "apply to stay here in the u.s. but he was denied"?, you say that He is tired of waiting on everything, what has been done to remedy his situation? He wont get his divorce papers until he pays the attorney, nothing can be done until he gets his divorce decree, either as a fiancee or as a spouse.

yes, you can come back and file but, he still would be under a three year ban, plus, being a native of a middle eastern country, will most likely put you on AP when the time comes. You could file a waiver, which might be granted but it would only add more time to the process. In practical terms, if he leaves the country without AOS your separation will last years. If he misses his kids, is there any chance that they could come and visit him here in the states? I am sorry but, the game changer was the long visa overstay.

Denied him what "the first time"?

How about you send the attorney the $1000 to get the divorce papers? Or contact the government? Or have a friend or family member collect them for him?

If he leaves you will not be together for many years while you wait on AP, the waiver and the process itself. Not the mention you may not even be approved. I'm not sure what the level of fraud is in Jordan but don't think just because you apply that you'll be approved.

The smart decision would be to file, get GC in hand and THEN leave (that is assuming you'd even get approved). If he wants to leave, then let him leave, but understand he may never come back.

We already explained that yes, you can go and marry him over there and then petition him.

However, you just said he "applied to stay here in the u.s. but he was denied". How did you apply to stay and why was he denied? When was he denied? This could be another complicating factor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Let the man go see his kids, if he's yours U will eventually get him, marry him there

come back and file I 130, he will need to give U certified divorced decree,gather

docs to show bonified marriage,u'll also get to know his kids, he pay his atty there for

papers , this will take close to 36 mths...............

I'm sure he doesn't. He is a good guy. Never been n trouble since he has been here. So we are going to get everything worked out now before he goes home. So then he will be free to come and go as he wants to.

His children are little and the exwife wont let them fly for 17 hours. I wish she would.

But everything is good now. Thanks for everyone's help.

My guess - tourist visa extension.
