THE STORY: Hello all I hope someone can answer this for me....ok so in Oct. 2012 me and my fiance' sent in the paperwork for the I129-F and he had to go back to his country to return to work. Than I went and seen him and meet all of his family/friends in Nov. 2012 for 10 days. He is coming to spend Christmas with me and my family and in the meantime I was informed from my work that I would be layoff do to seasonal downtime from the 21st of Dec.2012 to probably April 4st 2013 so we decided that I would go back with him to his country in Jan 2013 while the paperwork is processing...that being said...we decided that it would be Awesome if we just got married on the 21st of Dec. because than our wedding date would be 12/21/12 lol...

THE QUESTION: if we get married in Dec. and file the I130 before we go back to his country what will that do to the I120-f form that is being processed? If that I130 from isn't approved by the time I have to come back to the USA will he still be able to come and visit me? if there will be no repercussions from getting married before the I129-f form is approved what other forms do I need to submit when I submit the I130?

No good. You FIRST have to withdraw the 129 filing and have that accepted by USCIS and THEN file for the CR-1 documents. Why are you complicating the process?

No good. You FIRST have to withdraw the 129 filing and have that accepted by USCIS and THEN file for the CR-1 documents. Why are you complicating the process?

I am not trying to...so it is better if you allow the I129-f to process first..than get married and then file the I130? what other forms do I need to file when I file the I130?

NO, like baron555 said you first need to withdraw the 1-129f fiancee visa, if you get married then you need to file 1-130 cr-1 visa. write a letter to withdrew the 1-129f if you want to get married now.and start all over with the 1-130 and a new fee.

Welcome to the forum.

If you are able to complete the I-129F K-1 Fiance(e) visa process, immigrate to the USA, get married, file for Adjustment of Status, there is no I-130 associated with the K-1 visa process.

Should you choose to get married prior to completion of the I-129F K-1 Fiance(e) visa process, that will make you ineligible for the fiance(e) visa. You will have to do as baron555 describes, and start all over with the CR-1 spousal visa process.

Take a look at the K-1 visa flowchart, located in the "Guides" section, found at the top of the forum page.

Or leave the 129 alone and get married on 03/03/13.Or 04/04/14. Don't play games with this stuff. It will cost you money and time. PS. I don't know your religion, but having a wedding anniversary so close to Christmas usually means one gift to cover both occasions rather than two when the dates are more separated. :whistle:

That is incorrect. Follow the advice already given by forum members. You cannot use a K-1 Fiancee visa if you are already married, that is immigration fraud. Check out other similar-themed threads.

If you feel the dying urge to get married now, you MUST withdraw the F1-Fiance petition and then file i-130 AFTER you are married. Doing anything else WILL complicate the process for you....follow the advise given by our forum members.

You need to stop listening to advice from people who do NOT know this process. You cannot be married and have your fiance(husband) travel here in an 129f, it is a FIANCE visa, not a spouse visa. If you marry you MUST withdraw the 129f and start from the beginning and file an 130-petition AFTER you are married. This is your ONLY option if you decide to get married before the 129f visa is issued, end of story, comprende??????

I wouldn't get married and deal with the headache of changing just because of an awesome wedding date.

Having said that our wedding date (in American format) was 2/21/12. And surprisingly mild it was, too.

OK thank you were going to wait....so just to get this straight once the i129-f is approved and he comes here so we can get married ...can we go back to Belgium while the i-485 is processing? or are we stuck in the USA?

File the I-131 for advanced parole if he wants to travel outside the US while waiting for the greencard. It takes about 90 days or so.

The K-1 visa is a one-way, one-time entry into the US. For him to leave prior to having his Green Card, he will need for have his Advanced Parole, as Operator mentioned in his posting.
